only a judge can decide that, but I believe so if the driver has not been divulged (until the judgment you wont get clarity, if it goes to court that is)1

That would work but it depends upon whether or not you are happy to have this hanging over you for some time. I always want to get things cancelled asap and letting them know that you are up to speed on the law is worthwhile and, of course, if you pursue a counter claim, you have evidence why they are misusing your data and owe you for inconvenience etc.1 -

Sorry RedX, I'm not clear what you mean. Are you saying that their 'nonPOFA' claim is likely to not be legitimate or that it may be? Albeit a Judge would have the final say, which I do understand. Thanks again.0
