    I had thought it might be helpful to submit my WS or Defence Bundle too, so that the Procedural Judge can see the amount of work that has gone into preparing for this case and because my WS references the Claimant's unreasonable behaviour. Do you not think that's necessary?
    I think not.  The Judge won't read it as the case is over.
    Thank you, that makes sense. I've therefore amended my letter to remove reference to the paragraphs in my WS, if the Judge won't see it. What's your view as to the best method to submit the letter and costs summary to the Court, email or snail mail?

    When I have a moment I will also anonymise the 125 or so pages of letters and emails from PAS and their minions that you requested. Let me know your preferred way of receiving it all.

    By way of an update, after submitting the letter to the court that I had previously posted here fao procedural judge, which was to claim costs following the late discontinuance, I have now received this response from the court, stating that 'the matter was referred to a Judge [no mention of said Judge being the procedural Judge] who made the following comment; 1. If he wants letter to make an application he should file an application notice.' I wondered if anyone has had any success with this approach and if there any tips folk wish to share. Am I right in thinking that I simply submit a Form N252 and can I with my letter and schedule of costs?

    An application costs money, and convincing a Judge that the Claimant acted unreasonably is a very high bar.

    An application costs money, and convincing a Judge that the Claimant acted unreasonably is a very high bar.

    I'd leave it personally- I tried claiming a similar amount for my time spent researching and preparing my defence. But the Judge disallowed it even though he dismissed the parking firms case and awarded me costs. It's quite difficult to obtain from what I gather. From reading here it's only cases where their are exceptional and extenuating circumstances where the parking firms behaviour is proven as malicious or corrupt (i recall seeing it on some Excel/ VCS cases).

    There is nothing to stop you legally from sending them invoices for the time their dismissed claim cost you!  The fact that it was binned by a judge evidences it was a non-starter. I'd probably just do this instead!  

    Also I can assure you these clowns have lost money by trying to sue you. They aren't a big firm with a massive portfolio of sites like NCP or Parking Eye who can offset losses against the sheer volume of people frightened into paying, so these clowns have definitely taken a financial hit through this.
