I have received the following email from DCB, with the Court date being around the corner:
WITHOUT PREJUDICE
Good Afternoon
We write in relation to the above matter.
Our client is prepared to make an offer to potentially conclude this matter. We ask that you call us on 0203 434 0433 before 15/07/2022 to discuss this further.
We look forward to hearing from you.

I am minded to reply as follows:
Dear ,
Given that your client has no cause of action in relation to this claim, there is no offer that they can make that would be agreeable, because there are no legitimate grounds for their claim. However, in order to be reasonable and to avoid your client wasting both my and the Court's time, given the vexatious nature of this claim, I would be agreeable to settling now, with your client paying me the sum of £400, which is substantially less than I will otherwise be seeking under CPR 27.4(ii)(g).Yours sincerely,

Bittersweet, best describes this turn of events, because I was looking forward to meeting DCB Legal in court, after all the work I've done and the case that I've been assisted to build by everyone who's helped me here. I must give my thanks in particular to Coupon-Mad and thank you of course to everyone else who has provided their support and wisdom in this forum, you have been so incredibly helpful. Anyway, I received the email below from DCB Legal today in which they inform me that Parking Awareness Service have discontinued the case.
I hadn’t submitted my bundle, which included my Summary Costs Assessments, to the court or to DCB, because the 14 days from the case by which I was obliged to do this, whilst close, had not yet come around. My question is, am I still able to submit the Summary Costs Assessment to the Court to claim for these and if so, how do I do this? Thank you again all.

We act for the Claimant in the above matter and write further to your previous email.
Our client has instructed us to discontinue Court proceedings and close our file. Therefore, please find enclosed the Claimant’s N279 Notice of Discontinuance for your records.
The attached has also been filed with the Court.
We will now proceed to close our file accordingly.

Nice one, despite your frustration, a monkey off your back.It is now getting so predictable with almost all PPC/DCB Legal cases that are fully defended, end with an 'offer to settle' (especially with a FRO reply) then followed by a letter of discontinuation. Bullies and cowards in the same sentence!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
