What if you had completely failed the credit check? Do you still think you should get the deposit back when they may have missed out on another buyer and will have to readvertise it, why should they lose out because of your financial status? That is why these places take holding deposits so if the buyer flakes on them, they are not left out of pocket.
In this case was my fault and I would have not asked to be refunded.
On all PCPs I had so far, it never happened to be told they are offering me another deal on finance on the day I was supposed to pick up the car. Well, I only dealt with authorised dealers (but I guess all of them are regulated).0 -
I did some research and it seems the first stop is the credit card company and if they cannot help is the Citizen Advice Bureau and the small claims court.0

For what though? They haven't broken the contract, you have. What exactly will you put in your claim? I paid a holding deposit for a car, they held the car. The deal changed so I chose not to purchase, then then agreed to the original deal but I still backed out of the contract and want my money back.0 -
Putting aside my opinion on the likelihood of winning (and that of other posters), if you want to look to claim it back you want to make a section 75 claim on your credit card for the deposit.
Your credit card provider will then investigate and refund you if they believe your consumer rights have been breached.
If this fails, as you say you can go down the small claims route - moneyclaim online is the route you would go down to file for the refund. Again, this would be down to a judge as to whether your rights have been breached.
You will need to prove that there has been a breach of contract on the side of the dealer. I'm not sure how you would go about doing that given that they are willing to give you the car (now under the discussed payment terms), but the onus will be on you to demonstrate that is the case.0 -
