Yes they would have been paying your NI conts through Incapacity Benefit but it would have been a credits only case and you would have been paid Income Support due to Incapacity. You need to have paid National Insurance through employment in the relevant tax years to receive IB, as you have only had credits you would not be entitled to IB so they are right. You say you have tried to claim IB for the last 3 years, what were you claiming between 2002 and 2004?

As far as I can remember, myself nothing, my wife was working and getting WTC.
So unless I go back to work I can never claim IB?
Have you got a job yet?

    NO? Then :shhh:

Forget about claiming & concentrate your effort in getting back into work. It's so much more worthwhile.

As I said you need to have paid National Insurance contributions through employment and if you have not worked since 2001 those contributions are too long ago.

I believe you need to be in employment for the 2 years prior to an IB claim so yes you need to go back to work. If you can go back to work then IB will not be needed.

On what grounds were you claiming IS before it was stopped? I am assuming it was because you were unfit for work. However as you have missed several medicals this year I am sure that will not be re-instated without your having a medical. If all else fails you can claim JSA and look for a job. You are still a comparatively young man surely you don't want to waste the rest of your life on welfare payments?

I was claiming IS because I am unfit for work. I actually phoned the medical services people last week to arrange a medical, which was when they advised me their doc had deemed me unfit for work, I do not have a problem going for a medical if needs be.
I have an appointment booked at the job centre in November to discuss returning to work in some form, possibily working from home to start off with and take it from there.
I couldnt agree more with you about wasting my life on benefits, contrary to what some people might think, I felt a trillion times better a person, putting on my suit and going out to work everyday, and providing for my family, now words cant describe how useless I feel not being able to provide and having to rely on benefits.
I have also been referred to see an Orthopaedic Surgeon with a view to getting a spinal fusion so I can then concentrate fully on returning to work full time.
Have you got a job yet?

    NO? Then :shhh:

Now winnifred, you have been told not to make this into another argument.

    Not sure who winnifred is?
Not making any arguements. I am heeding the advice of the pm that both you and I amongst others received today and putting people on the ignore list, shame others cant heed that advice and resort to little schoolkids behaviour and changing someones name!!

Feel it's really strange as you don't know what I'm typing as I'm on 'ignore', I find that a bit odd. I reached out to you on PM as a fellow MSE member...despite your 'history'....sorry if you felt I was abusive...I'm more than happy for you to detail the 8 abusive PM's on this thread. Can I feel equally free to 'out' you weymuffred?

    It's you I guess. I didn't get a PM...I feel left out!
