    So they accessed your data under the guise of being a parking company without being in an ATA? I would get back on to the DVLA and kicking up a stink.
  • we went thru this when ANPR ltd got booted out and joined the credit sevices settup

    they are NOT in a recognised ATA to use that form and collect data ,

    I wonder what they have written in the ATA box

    So the BPA just replied saying they aren't members - they left the membership on 25th Jan 2018 - a few days after my incident lol, very annoying!

    They might just have got the request in on time - but need the DVLA to confirm that.

  • I knew I had the data , this is from the DVLA in regard ANPR/CSA

  • THE CSA is NOT recognized as a relevant ATA for the purpose of releasing data for parking/tresspass

    Incident: 19th Jan
    DVLA Request: 24 Jan
    PPC leave ATA: 25 Jan
    DVLA process Request: 01 Feb
    NtK: 05 Feb


    Their request was made on 24th Jan - so looks like they're just in time in terms of the request. Interestingly though DVLA say the application was processed on 01 Feb. That means DVLA must have accepted the fact that they were in an ATA when the incident happened, but will not be in one to carry out 'enforcement'. I think I'll complain about this to the DVLA, as at the time they released the data, they weren't in an ATA.

    DVLA also confirms "allegation that the terms and conditions of private parking as reasonable cause" - ie not byelaws. They must know POFA doesn't apply, and if they're not using byelaws they can't even bring in Owner liability. So they have to be going for the Driver - and in this case the Reg Keeper isn't the Driver, so they don't have much hope! The Reg Keeper isn't the Owner either, but that's largely irrelevant anyway IMO.
  • Also for a v888/3 request, is there any requirement to be ATA registered? I know there is for KADOE, but do we definitely know they must be for the manual request?
  • I think they have used v888/3 as I cannot see any "adaptis" listed on the kodoe readouts

    clearly asks for name of ATA , and data protection number , as the form was not prosessed till `1st feb , then they told lies or DVLA did not check


    I would ask the DVLA for a COPY of there request
