Just send the template appeal as it is. No changes needed.

Send it three times - once for each PCN.
Obviously change the PCN number on each.

The idea is that Britannia will recognise the appeal as coming from this forum and realise that they are going to have difficulty getting money from you.

This means there is the chance that they may give up and allow the appeal.

But if not, then you stand a very good chance of winning PoPLA appeals.
  • Thanks for the explanation ....... much appreciated

..... but so far I still feel that I need advice on how to proceed and what my chances of succes with an appeal vs potential court fees.... thanks again.

It is a scam, totally unregulated, and Trading Standards, are not interested, but,

All the advice, answers to your questions, and cribs you can ever need are available on line, either here, peppipoo, Parking Cowboys, Leagle Beagles, Honest John, No To Mob, Patking Prankster, or CAG. Read a few thousand and you will get the hang of it.

Hi again....... I intend to appeal all 3 PCNs to Britannia Parking via their website. I was advised to use the standard template letter....... however, I have made a slight modification to suit my situation which I highlighted in red below. Does anyone see any issues with this before I submit my appeal ?

    Dear Sir/Madam,

    Re PCN number:

I am the keeper of the vehicle which received this purported 'parking charge'. There will be no admissions as to who was driving and no assumptions can be drawn. I am not liable and I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs are in small print and the onerous terms are not readable. Additionally, the car park is unlit during the hours of darkness and none of the signs are illuminated. I have taken a number of photographs during both daylight and darkness hours to support the above and these will be made available to POPLA.

Should you fail to cancel this PCN immediately, I require the following information with your template rejection:

    1. Does your charge represent damages for breach of contract? Answer yes or no.
    2. Please provide dated photos of the signs that you say were on site, which you contend formed a contract.
    3. Please provide all photographs taken of this vehicle.

I am alarmed by your contact and I do not give you consent to process any data relating to me, or this vehicle. I deny liability and will not respond to debt collectors. You must consider this letter a Section 10 Notice under the DPA, and should you fail to respond accordingly, your company will be reported to the Information Commissioner.

I have kept proof of submission of this appeal and will also be making a formal complaint to your client landowner.

If you are a current BPA member, send me a POPLA code. If you are an IPC firm, cease and desist with all contact.

    Yours faithfully,

Do what you think best. You've already had my advice.

You really are over thinking this.

It's now at least two weeks since you received the NtK.
How long have you got to appeal?

Know your enemy, watch this and, if it goes to court, be sure to mention to the Judge the denouncement by MP after MP of this company's MO in the House of Commons yesterday. IMO they are on borrowed time.

They won!!!8217;t read the appeal properly and POPLA wont care less about the lighting.

If you want to amend it you arent going to do any harm but it wont achieve anything that wouldnt be achieved anyway.
