I initially enquired through Allay about PPI, but never filled in or returned their forms. I sent Lloyds a template letter from here, and received an award of nearly £7k. I then received an invoice from Allay for £1.5k.
I still had the unsigned forms from Allay, and emailed them this info. To be fair, they came back to me, (in writing), in less than a day, confirming I wouldn’t have to pay their invoice.0 -
Allay lost a court case on Thursday that they bought against someone who originally filled out an Angie's Advice 'free PPI check' on Facebook but did not sign & return paperwork subsequently sent to the defendant by mail . It was a classic case of Allay relying on a digital signature on a letter of authority that the defendant did not in fact provide.
The judge held that no contract was ever struck and that even if there was, no cancellation form was provided under the requirements of distance selling regulations and no copy of the contract was provided in a durable medium.2
