MSE News: New code of practice for parking firms
Former_MSE_Megan_F

Some private parking firms will have to abide by a new code of practice to be able to access owners' details from the DVLA - but the new Government-backed legislation is unlikely to stop rogue firms that don't sign up to the new rules from issuing tickets...

Could MSE now celebrate by putting right the awful errors in this article, please, at long last:
https://www.moneysavingexpert.com/reclaim/private-parking-ticketsMartin found just how crucial evidence can be when he got a ticket at 6.35pm, yet managed to take a photo of a sign showing he could park after 6.30pm – see his Parking fines reclaim blog. (Although Martin's ticket was from a council, the principle of gathering evidence is the same for private tickets.)Proof of mitigating circumstances. Keep anything relevant, such as receipts from a recovery company if you were broken down.
Even worse, what on EARTH were you thinking of here (below), MSE? With this rubbish telling people to actually give their name and address data to a company who CAN'T get your data?!
https://www.moneysavingexpert.com/reclaim/private-parking-tickets#route2''How to dispute a ticket if the parking firm's NOT part of a trade body''
2. The no-nonsense approach – tell 'em you won't pay
route most should take. This is our suggested approach for most. Here you don't follow the route the parking company sets out; instead, you're simply going to treat the ticket like any other invoice, and write back to tell the firm politely but firmly you're not paying and why you think it's unfair.
If you're opting for this route, simply write to the company. Your letter should explain why you dispute the unfair charge, but also avoid giving them any details that could be used against you or the driver. Use the template letter below to help.
Whaaat??This is our suggested approach for mostUse the template letter below to help.
Why?! Why is MSE telling people to give their data to such a firm? WHY?

From the article ....
"But, despite Government claims that it's "putting the brakes on rogue operators", it admitted to MoneySavingExpert.com that companies which don't sign up to the code of practice will still be able to issue tickets. If the companies are not currently a member of a trade association they are unable to access the DVLA data anyway so the deterrent does not affect them. "
Any old fool and his dog could issue a parking ticket
They would waste their time unless they can find out
who the keeper was.
Of course we know it's not difficult to get info from
the DVLA ... BUT THE DVLA needs to apply strict rules
to prevent this0 -
I agree with Coupon.0

But this is the same terrible advice that Martin Lewis said
on TV last year ???0 -

Not really. Some unaffiliated parking firms rely on windscreen tickets, knowing that they can't get keeper details if no contact is made by the motorist.
But they still receive payments for around 40% of the tickets, arguably a more lucrative business model than bothering with ATA membership fees, codes of practice, dodgy debt collectors and incompetent solicitors.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
Yep, and MSE is actually telling its readership to GIVE THEIR DATA to a rogue firm who can't get it.
MSE Towers, please deal with this and right that wrong - your advice on private parking tickets has hardly improved much in years (the interactive template letter is still diabolical, and gives away the driver's identity - eeeek!!).
But to actually tell people to write to an unregulated firm, is inexcusable madness, financial suicide because hapless saps will then panic & pay when aggressively pursued by those scam artists who couldn't have known the address of the driver had it not been for that 'helping hand' from MSE's own advice!
What was the person thinking who wrote that?
Your recent article warns:''but the new Government-backed legislation is unlikely to stop rogue firms who don't sign up to the new rules from issuing tickets...''
You are barking up the wrong tree and MSE, you are costing people money with this awful advice. You might even get people being sued because of your awful article telling them to write!
Unregulated firms are really not an issue AT ALL unless people are daft enough to write to them.
Here is the forum advice thread, with the correct 'one size fits all' appeal template, the one that stops people rabbiting on pointlessly about what happened and who the driver was:

Did MSE know we also see 99% of people win at POPLA, and the same figure won in court last year v scumbag PPCs, using fully-coached court defences and being assisted right through to hearing/discontinuance?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

OMG Martin Lewis has just repeated on National TV, the doomed 'advice' to give a phishing ticketer (who can't get your data) your data!
WRONG WRONG WRONG WRONG WRONG WRONG
MSE you cannot get more wrong. It's like telling people to reply to badly-spelt phishing emails!!
How can MSE stand by this awful, awful, hopeless advice about non-BPA/IPC fake ticketers?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I am beginning to think that Martin is not so sharp as he thinks he is. rYou never know how far you can go until you go too far.0

martin is speaking for himself , he has no interest in MSE , he sold it
and should not make any connection between himself and MSE
MSE should also edit the news feature and link it to this thread
