Out of Warranty Phone Replacment. Three UK

[FONT="]All of a sudden my iPhone 5S which I have had on contract for just over a year has decided to not want to charge above 3% any more, Typical as its 10 days out of warranty. Know I have been to apple to speak to these so called "Genius" who have run some diagnostics of the phone to find no fault logged and can’t find a problem with the battery and have suggested as a resolution that the phone be replaced for a reconditioned one for cost of £249.
This is where things get interesting as I am still in contract with Three UK under consumer law I should protected for Three to replace or repair the mobile providing that there has been no physical or any water damage. Having Spoken to Three they have stated that they will honour the repair providing it still meets apples Warranty conditions but would like me to pay the cost upfront and they claim them back from three by showing the “Genius” repair sheet and also a payment receipt. [FONT="]The problem is at the moment I am short for any disposable income to be able to pay for this upfront and claim the money back from Three. Do you think that Three are making a reasonable request from me by asking me to pay this upfront and claim back from there or should they be repairing the phone themselves without me paying first? The other issue is that if I pay this some and trying claiming it back and they refuse I’m in a worse situation. [/FONT]
[FONT="]I have spoken to the customer complaints/relations team and have suggested that I email them over the diagnostic/quote I have got from apple and they deduct this from the remaining line rental which is £200 saving them £49 if I had the phone repaired and me getting another 24 month contract with them with a new phone. But they point blank refused and said that this is something that they are willing to do. Is this request I made in line with what I am entitled to ask for.[/FONT]

Key here is do Apple agree its not charging .
They have said no fault logged and battery OK .
As its over 6 months since purchase you are wrong re consumer law . Its up to you to prove the faults not the vendor .0 -
Yes apple have admitted the fault is there, as in the quote they have said they have "was able to observe issue in store as device powered off unexpectedly". The issue isn't with apple here the issue is with three asking me to pay for repair and claiming it back. Apple have said it is covered under warranty as theres no physical damage to the phone and the lci hasnt been triggured.0

Covered under warranty for the mere sum of £249?0 -
Sorry i should have said when they say covered under warranty i mean the warranty policy as if it would be in 12 months but as this us an agreement with apple and three outside of the 12 months, hence why i am asking wether three need to foot the cost rather than me paying for it and then claiming it from them.0

Your purchase was from Three, so unfortunately you will need to persist with them.
A friend has been quite successful with an iPad warranty with Apple, it was purchased in the UK and was replaced without quibble at an Apple Store in Spain... the iPad was 18 months old and “dead”. The genius in the store said Apple products were covered by a 2 year EU wide warranty.
I only deal direct with Apple, not high street 3rd parties, I did have a fault on an iPhone 5 some time ago and it was swapped without question... from various threads on this forum it appears that phones bought from Apple tend to be treated better with regard to warranty, compared to dealing with phone shops...

The length of the airtime contract has nothing to do with the length of the phone warranty, if that's what you're hoping for.
