Not sure what to do dispute or ignore.

Parked at Cheltenham train station before catching the train for a day out of shopping with my mum in Birmingham. Parking is limited there and we though we had perfect timing as there appeared to be one space left. Only when we got back we had a parking ticket from APCOA parking (uk) ltd for not parking in area.

So the space had a sign about half a foot maybe a foot to the left of the car that said turning area no parking (we were not over the sign in any way), beyond that was space for at least another car width if not two which we considered the turning area that the sign referred to. It was only after returning to the vehicle and seeing the parking ticket that we noticed that there was small white dots to the right of the car but not to the left, however, I still dont feel its clear that the spaces ended and as we were not over the sign for no parking and there was plenty of space to the side where we thought the sign referred to for turning we didnt consider that it may not be a space.

I took photos of the spaces, sign, turning area etc. But ultimately as this was a genuine mistake and in my opinion not clear where it is & isnt exceptable to park shall I dispute or ignore?

    Have you had a notice to keeper yet?
  • Nothing through the post just a parking notice charge stuck to the windscreen which says I wasn’t in parking area. Payment within 28days £100 but if I pay in the next 14 then its £50 it says I can put a challenge in in writing.

    If you are the registered keeper and your address is correct on the V5c do nothing until you get a Notice to Keeper.

    Currently many train stations are covered by byelaws. There is massive confusion between the parking companies, dvla and the DfT as to what to do with byelaws tickets. It seems currently the dvla are reluctant to give out details of the keeper.

    If this isn’t a byelaws ticket you have nothing to gain by rushing.

    Read the thread at the top of the board that tells Newbies to read it first.
  • Thank yo waamo, I did read the newbie post but still found it confusing. Thank you for your advice regarding byelaws and the dvla it made it a lot clearer fir me, I will wait it out and see what happens.

    not sure how apoco are working , but we do know its railway land (no POFa) so no point in trying to outfox them by sending lerter on day 28i hoping they fail POFa , because it does not exist and never will on railway land

    the whole situation is confusing , but do not hand them the driver details on a plate

    they ticketed the vehicle , not the driver

    so wait for the NTK to come in the post , a postal notice to the keeper, and appeal as KEEPER (not as driver) to that notice with the template appeal

    if they decline it and issue a popla code, then its a popla appeal to kill it off

    until the DVLA , or the Transport Secretary , or the Government change the rules or laws, it will remain a confusing topic , but in the meantime bylaws exist and POFA 2012 does not apply, which means the advice is tailored to meet those particular criteria

    and the DVLA should not be giving out KEEPER details to private parking companies

    Appeal using the template from the NEWBIES thread.
    If/when it is rejected, make a PoPLA appeal if you get a code. Byelaws probably apply so you want to drag this out past 6 months after which it becomes statute barred.

    Do a search of this forum for "APCOA Byelaws", selecting Show Posts to get more info about this scam.

    Make sure the driver and owner are not identified. Appeal only as keeper.

    BUT only appeal if the NTK comes after day 28 and by day 57 , but appeal anyway to any postal NTK, not before , as KEEPER

    so the driver does nothing and keeps the windscreen ticket but does nothing with it

    THE KEEPER appeals to any postal notice

    TBH, APCOA are so poor, and you WILL win at POPLA (as long as the driver is not divulged) that it's your choice:

    - either appeal now as per the NEWBIES thread

    or

    - wait for the NTK and appeal as per the NEWBIES thread (same appeal template fits all) but you really don't need to. The NEWBIES thread makes it clear that the tactic of waiting for a NTK first, is ONLY for IPC firms, or non-ATA firms, or for Indigo ONLY where they've issued something called a PENALTY at a railway car park. Not your case, not needed, yours is not a penalty from Indigo.

    No need to come back at each stage and ask, it's not confusing, it's easy. Could appeal now.
