APCOA Swindon Train Station POPLA

hello, I'm looking for some advice on whether i have a valid appeal for PCN at Swindon station in Nov 17 before deciding whether or not to pay the PCN. Having read through this website I made an appeal to APCOA under Bye-laws and only being a registered keeper. I have not identified who the driver of the vehicle was. APCOA rejected my letter but sent a POPLA reference and confirmed they continue to issue the PCN under BPA guidelines breach of T&Cs, not under POFA 2012 or bylaws.

I was planning to appeal to POPLA using 2 issues. 1 whether they can prove they have permission from the land owner hence showing the contract, and 2 being a registered keeper they can only expect me to pay if issuing PCN under POFA code.

Do you think my appeal is valid. Any advice would be appreciated. I begrudge paying these PCNs and adding to the profits of APCOA but am struggling to understand so much of the content written online to determine if my appeal is valid without using signage or other reasons.

    APCoa are playing the numbers game , you waste time writing a POPLa appeal they read it and throw in there hand , saving £27

    Nobody in their right mind offers up their wallet for APCOA to put their grasping fingers into it to extract £100.

    If they do not know who was driving, or who owns the car, there is nothing they can do. The cannot go after the keeper, who can tell them that any further contact will be ignored, and that all further contact must be directed at the driver/owner.

    They may say that they are making the assumption that the keeper is the driver, they may even quote Elliott v Loake, but they would struggle to prove it in court.

    PoPLA no longer wish to adjudicate Railway Land claims, so all they can do is send debt collector letters, and make threats which are unlawful. When see receive your appeal they will throw in the towel.
    You never know how far you can go until you go too far.

    that is no worry as the landowner has invited them to work


    the worry for them is that the land comes under bylaws and they cannot override them
