Has anyone had a ccj put aside by parking eye?

    Need to write a formal witness statement? And as suggested above a statement of truth? Is this enough?

    YES, you need to write a proper WS. Otherwise it isnt evidence.

    The Statement of Truth is what is mandatory, as this verifies the statement.

    Ive started a new thread, I need help after finding a ccj letter late it went to my neighbours, I slid straight away anyway it went 2 days over the month period allowed.
    Anyhow I wrote to parking eye and requested consent to set aside which they sent me yesterday. What now? I!!!8217;m confused, after recieving a lot of conflicting advice I called the court on 3 different occasions ;
    Person 1 said only £100 payment and consent to set aside form and evidence to be sent in.
    Person 2 said £100 consent form and n244 form
    Person 3 sounded most confident and also checked with line Magager said only consent to st aside form and £100 fee and no n244 form or any other documents required and that!!!8217;s it!!!8217;s fairly simple .
    Reading on here people are saying send statement of truth and witness statement.
    Can someone please tell me the correct procedure as I don!!!8217;t want this ccj to be set aside to be declined as there!!!8217;s no relevant paperwork.

    Reading on here people are saying send statement of truth and witness statement.

    So do you think what we are saying is different? If you read an N244 form, it asks for a WS, so that's why we tell you to supply one with the N244 because it's part of it.

    If the third person said ''no need for N244 in this case'' they might be right, but normally a set aside does need one. Not sure why you are getting so bogged down, why not just send the N244 and WS anyway with the consent and £100 fee?

    WITNESS STATEMENT

    I am xxxxx and I am the Defendant in this matter.
    This is my supporting statement in support of my application dated 3rd February 2018 to :
    -Set aside my judgement dated 28th November 2017, as I did not recieve the judgement (In default) letter until it was too late as it was posted to one of my neighbours house by mistake.

    • Judgement
      1.1 I understand that the Claimant obtained a judgement (in default)against me as the Defendant as I did not pay the amount of £197 within the one month time frame. The reason for this is as above, the judgement ( in default) letter went to the wrong house (one of my neighbours) who then passed it on to me late. As a result I made the payment on 28th December 2017 the day I recived the letter, this was exactly one month but due to the bank transaction time it went two days over the one month period given to pay within.
      1.2 Had I recived the judgement (in default) letter on time I would have paid the full amount well within the time frame.
      1.3 Even after recieving the judgement (in default) letter late every reasonable effort was made to pay on time as soon as I was aware.

    • Request to set aside judgement
      2.1 As mentioned above due to reasons out of my control the payment made to the Claimant went two days over the one month allowed period, but the payment was made as soon as I was aware.
      2.2 The claimant has been paid in full.
      2.3 The claimant has agreed to set aside with consent mutually.
      2.4 The Claimant has sent me a signed consent order.

      2.5 Considering the above I request for the judgment made against me to be set aside.

  • Also when I get someone else in the house hold to write a statement of truth is that write separately on another paper stating statement of truth? and do they say the facts of the witness statement are what they belive to be true or do they write their own version and declare that to be the truth?
