POPLA on hold due to BYLAW

    That's why I was thinking of emailing POPLA who are telling me the case is on hold at the moment - If popla can set the fine aside I can get the money back.

    Whats a complete and utter shambles isnt it :( if i hadnt of paid then i could under thand, but the fact that i had paid the correct fee, and even had proof that i had paid.

    If your dad has paid then it may be difficult to get the money back. Hopefully a robust complaint to the BPA might see them refund the money as it shouldn’t have been demanded whilst POPLA was technically in play.

    If they don’t play ball then it looks like your dad may have to put a letter before claim in followed by a claim if necessary. I would fully understand if he didn’t want to do that.

    a: not a fine (no fines in private parking)

    b: they cannot set anything aside , they can only go from advice and not offer appeals on railway land any more

    tel lindigo , paid under duress , you want refund as they are not entitled , then start court action , letter before claim , papers and £25 costs (you get back)

    My dad wouldn't put up a fuss, and if you put anything that has big words, and or mentions court or fines, He will just panic. He has already told me just to leave it now he has paid.

    But that is not the point - It was wrong done in many ways.

    Can private companies issue Penalty charges? I thought that was just the police or local council that can issue them.

    It’s not a penalty. It’s a demand for money to avoid prosecution.

    Ok - So I will send a email to Indigo with all the information I have got today, And advise that My father was bullied into pay the fine even though I admitted to Indigo in the 1st place that it was myself driving and giving my details over (Id never had a parking fine before so I wasn't sure what I needed to do, I was sure that it wouldn't have got as far as this)

    Ask them to refund him the money - If not I will take court action against them? or leave that bit out?

    Complain to the BPA too. They can apply some pressure.

    especially how the debt collection continued under force whilst an active POPLa appeal was active

    that in itself is sanction points


    I have a funny feeling that indigo will be the next to jump ship , as the BPA (and to some extent) have effectively killed a huge % of there income

    But I was the driver not my dad, He is the registered keeper of the vehicle, But I made it clear from the next day that I was the driver and passed over all my details.

    I will write to indigo tonight with all the above points, and advise of court action, and also complain to the BPA too.

    Thank you all for your help and advise. I will keep the post updated with any outcome I get
