I'd agree that, as there was no damage, there was no "accident" to report (see definition in Road Traffic Act). However, it depends on what the insurer requires to be reported. Maybe they refer to "incidents".
But as already mentioned by others, the RTA does not give a definition of the word "accident".
All it states is that if an accident occurs and there is damage or injury to a third person then you have to give certain details to those involved or to the police.
Therefore if there is an accident which doesn't involve injury or damage, you don't have to provide these details but there may still have been an accident.0 -

This might help you from the PNLD.
Accident - although not defined in the Road Traffic Acts an 'accident' has been held in court to be 'an unintended occurrence which has an adverse physical result'. However, it is left to the courts to apply a common sense approach, perhaps asking whether an ordinary person would in the circumstances of the case say that there had been an accident. The driver is under the obligation imposed by this section even though the accident may have been caused entirely by the fault of someone else.
So in the case of this OP, would it be an accident if there was no black box? The answer is no.0 -
You state "if there was no black box?" but there was a black box so this "what if" is pointless. You may as well have stated "what if there was no bin behind the car"AndyMc..... wrote: »Accident - although not defined in the Road Traffic Acts an 'accident' has been held in court to be 'an unintended occurrence which has an adverse physical result'. Surely the bin being moved (or possibly knocked over) was unintended and could qualify as "an adverse physical result" and as the people who post on here would no doubt qualify as ordinary people then if some of these "ordinary people" think that what happened to the OP's son was an accident then using the definition you posted above, there had been an accident.0 -

Where’s the harm in touching a wheely bin?0 -
Look up adverse in the dictionary and the most appropriate meaning is harmful. Then look up harm, there is no accident unless there was damage to the bin.0

So if you knock me down in your car, and I'm uninjured, no accident has occurred? Therefore, you wouldn't need to stop as, according to you, no accident has happened.
I really think you should get real."There are not enough superlatives in the English language to describe a 'Princess Coronation' locomotive in full cry. We shall never see their like again". O S Nock0 -

We are talking about an undamaged bin.
If it could and highly unlikely it would be determined you were uninjured, then please feel free to show us the need to stop.0
