Deductions from pay

Im in a salaried job paid monthly and yesterday upon checking my bank i saw my employer had only paid me £361 for the entire month.I called HR where i was told that they had deducted 8 days pay (almost £1000) from my wages to cover time off due to sickness in Nov and Dec of 2017.
I had no prior warning that they would be deducting ANY wages yet alone almost my entire salary,my local citizens advice isnt open until tomorrow but i was hoping someone here more clued up on employment law could possibly help or advise me further as im not sure if they can do what they have done?
We are unable to pay our rent and council tax and im unable to return to work as i now have to find a weekly paying job to prevent myself my wife and daughter from becoming homeless,HRs response was to laugh and told me to speak to my bank manager
any help is greatly appreciated.

How many hours per month do you work ?I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0

Why would you be homeless? I mean that's just ridiculous.Im in a salaried job paid monthly and yesterday upon checking my bank i saw my employer had only paid me £361 for the entire month.I called HR where i was told that they had deducted 8 days pay (almost £1000) from my wages to cover time off due to sickness in Nov and Dec of 2017.

Yes but eviction takes months and months. By that point you can clear up the mess with your employerI went from weekly paid to monthly paid and were currently unable to clear the arrears and make this months rent payment due to the amount deducted.unless i can find a new job this week then we should be fine.
Why are you quitting straight away, it doesn't make sense.0 -
because we cant make it through to the end of next month with the amount i was paid, rent and council tax alone is over £600,and my employer has no interest in clearing this up as i said they laughed at my situation.im just looking for some advice regarding the deductions not judgement.Yes but eviction takes months and months. Were you of sick during Nov and Dec but paid normal salary in December? It sounds as if you were overpaid then due to the way Payroll processes work this was the earliest to deduct. How many days did you have of? What does your sickness absence policy state regarding pay due to absence. Have you received statutory sick pay which is due after first 3 days of sickness.0

You spoke to one person on the phone! If you turned up in person, raised an official grievance with your manager or the managing director. Explained that the deductions were causing you unnecessary hardship (and that the company may be liable for any, mitigated, loss you suffer) I suspect the reaction may be different.because we cant make it through to the end of next month with the amount i was paid, rent and council tax alone is over £600,and my employer has no interest in clearing this up as i said they laughed at my situation.im just looking for some advice regarding the deductions not judgement.
Judgement? I wasn't judging you, I'm saying that if you just walk out, your reference is hardly going to be glowing. A weekly paid job isn't going to pay as much typically. AND you still need a few weeks to find it (atleast a few weeks)
Eviction takes months and months, the priority is to keep an ongoing income. Not paying rent for one month is the better option in my opinion.0 -
