  • I'm panicking that I have little time to write a skeleton argument and I still don't have the claimants witness statement. Court case is next week.

    Should I prepare one now without the claimants WS?
    Should I email to the court before the day of the court case or hand it in on the day?
    Do I need one? I would prefer to do as little speaking as possible so thinking I should.
    I am also struggling to pull one together as not sure what I need to put in it...I have been searching the forum but haven't found many examples....

    Please can anyone help? Thanks

    Because very few people write a formal SA, it's not a requirement. A SA should be an aide memoire to point the Judge and Claimant to the important points of your case from your point of view. It can act as a memory jogger for you about what you need to cover.

    But unless your case is complicated, the hearing might not take more than around 20 minutes and the chances of the Judge reading, let alone ploughing through it all at the hearing, is remote.

    If all you want is something to remind you of your key points, you could simply jot it down in a notebook or on a sheet of paper and just refer to to it as necessary at the hearing (if you even get the opportunity). No need to copy that to anyone else.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Well Gladstones witness statement arrived today (8 days late) They had obviously waited for my statement. They have counter argued every point I made with cases etc to back them up. They have slated my defence as being cribbed from the internet.

    After reading it I now feel pretty deflated and not very confident I will win the case next week :(

    Why on earth would they do that. The internet is the best thing since sliced bread. Could it perhaps be because they have read some of these.

    Have you done this? Is it signed with a 'copy' signature of 'Jack someone' matching those shown by bargepole?

    Have you read CEC16's thread so you can print out the Consumer Rights Act Schedule 2 (unfair terms list) and highlight 6, 10 and 14 and hand that out at your hearing, like I did in Southampton?

    READ IT NOW, it is important. You should be FAR more confident!

    Here (below) is what someone else just prepared to submit in their case (as you have already filed & served your WS, you can add stuff about the CRA 2015 with a skeleton argument before the hearing - or just ambush them with it as you CAN when it comes to the CRA 2015!):
