Parcel left in bin gone to refuse depot - who is responsible?

A table we purchased whilst on hol in India on 13 Dec – was delivered on 21 Dec by FedEx (left in recycling wheelie bin with no postcard through our door …Xmas was 4 days later, filled with Xmas stuff and has gone for recycling...) We only knew table had arrived in UK as FedEx sent in a request for us to pay import fees last week. On contacting FedEx this week to find out expected delivery day, they advised delivery had been made on 21 Dec signed for by a P Scott (not us or anybody we know) at 1330 hrs & left in wheelie bin … FedEx are not accepting responsibility but are happy to refund fees! They advise it is up to Indian retailer and courier to replace table – however they have fulfilled their role - table arrived in UK, it is the failure of FedEx in UK.in our opinion. (Retailer in India has since emailed over all his paperwork from courier showing all the tracking arriving into UK). We are also surprised that the import fees were requested 20 days after the delivery? Usually these fees are paid first before a delivery is released ... Thoughts anyone, thank you

Doesn't look good...did u pay by CC...if so try a charge back.Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0 -
Was it a table for a dolls house? How did they manage to fit a table in a bin?0

So it sat in your bin for at least 6 days (4 to xmas plus holidays) and you put stuff in the bin and you didn't notice it was even in there?0 -
You should persuade the retailer to raise a claim with FedEx for the lost item - FedEx seem to have accepted liability if they're not chasing for the duty, so should be straightforward. Only the retailer can do this.
The retailer should then send you a replacement. You may have an issue if the item wasn't properly insured.
You may have additional / fewer rights under Indian law but it's unlikely anyone here can advise on that.0 -
Perfectly possible, especially if weather isn't good. Do you always inspect yours?
I look in it before I put anything in it which the OP said they did.
And the shipper and FedEx would have given a tracking number and it can be tracked throughout its journey.
FedEx hasn't admitted liability - because they can only do so if there is any to the shipper who sent it as this is where the contract sits.0 -

Does it say they looked in the bin?
You assume the sender forwarded a tracking no. to the OP?0
