brother committed ebay fraud

My brother ripped someone off on ebay for £900. He sold an I phone which he didn't own. He drew the money out, will paypal taking the money out of his bank even though he's got nothing in leaving him with bank charges or will it deduct from his paypal balance?

He sent a mobile phone box with his old phone in and a tracking number.

Can the police and ebay prove that he didn't send the real phone?

He doesn't want paypal or ebay trying to take money out of his bank account which has nothing in (he doesn't work) and be charged fees for every time they try taking money out of his account.

I know they charge around £30 pound if they try taking money from his bank account if there's nothing in.

Will they do this? Try taking money from his bank or just deduct it from his paypal balance?

Will he get charged every time they try taking money out of his account if there's nothing in or will it just minus his paypal account?

    Of course if the buyer files a not as described case with photos then Ebay will just reimburse the buyer and put your brothers PayPal account into a minus figure and he will have to repay this, and can lead to defaults and credit file consequences.

    If no payment is reached then they could take action to take funds out of the account linked to PayPal.

    also paypal is a financial institute so could take even further legal action/criminal action for intentionally defrauding a bank, theft and much more. this can lead to all his bank accounts being closed and unable to obtain any form of credit/bank/savings if they put a cifca marker on him

  • Ok so lets look at this from another angle,say a seller sends an item that's 100% perfect and as described.


    Buyer says "Hmm lets rip this chap off and claim he sent an old sock and I'll have both the phone (can be sent abroad so locking/barring has no effect) and the money after PayPal simply refund me for goods not as described.

    Question for those who state PayPal will do XYZ...what proof will they have, they only have one persons word against another person, yes they do refund for items not arrived or not as described, but when its £900 id say they would refer back to some terms buried in the contract you have with them which states its up to the individual to sort it..lol

    After all they need hard evidence and cannot simply act on one persons say so.

    So the user is here to try and quiz everyone into how to deal with this and what the consequences are so they can sleep easier at night.

    SIMPLY, Don't do fraud. Plus paypal locks funds for 21 days on "new" paypal and those who haven't sold much on ebay, Going by the OP's words they haven't done this. SO not sure how the funds could have been withdrawn.

    I cannot actually believe someone has the pure cheek to come on MSE forum and ask this. This is beyond a joke or any trolling! I know what will happen and know how ebay and paypal work, But i'm not going to say what will happen and appease a scumbag.

    To answer the question - what will happen is that eBay will charge Paypal account the £900 and refund the buyer. Paypal will then attempt to recover that amount via the users linked bank account (ie pull a £900 DD) or debit card. With no funds in the bank this will fail. The bank may or may not charge for the failed attempt - depends on what account he has got etc.

    In any case, Paypal (like any financial institution) will recover the funds from your brother in the usual way starting with emails/letters requesting the payment all the way up to court action and bailiffs.
