  • Write to the DWP and ask if spending the money will be classed as deprivation of capital under the rules. If you have a letter from the DWP saying it isn't deprivation then go ahead and spend it. If at a later date they say it is deprivation then they can't do anything about it as you have it in writing. There is something in the legislation saying it isn't deprivation if you have been misadvised in writing by the DWP.
    I enjoy flower arranging, kittens, devil worship, the study of serial killers and their methods and road kill jigsaws.

    OP - take heed of this please. Don't enter into any financial commitments until the money actually arrives in your bank account. As Robin says, a year or so is not unusual at all.

    Deliberately getting into debt simply to avoid the necessity of declaring it to the DWP is absolutely fraud. They know they’re getting money, hopefully enough for what they want. They don’t need to lend or put it on credit.

    Oh I have no idea, as there won't be any records of the transaction with HMRC or anything like that. It all gets handed over by the solicitor in a brown envelope.

    If speaking to a consultant, it might be worth asking about a new technique to help reduce weight. A gastric balloon is swallowed by the patient, then inflated.


    I know very little about this, Doctor Hillary Jones was speaking on TV about it a couple of days ago, and he was saying the new technique was non-invasive, and should help many people. It would also be much cheaper than surgery.


    Worth asking your consultant about.

    If the money depends on a property being disposed of, it could take a number of years to pay out. The property may have to be sold at a lower than expected price and solicitor fees could continue to eat into the estate as time passes, making the full amount impossible to pass on.(This is happening in an extended family of ours)

    It's highly unlikely that DWP will give a simple Yes/No answer to a general hypothetical question about spending money from an inheritance. Each situation will be examined on its merits - at the time.

    They will reply - and they do - have helped a number of people when I posted under Housing Benefit Officer do just this.
