    Not in my experience.

I was knocked off my motorcycle and sustained serious injury. The Procurator Fiscal decided not to prosecute the lady driver. Fortunately there was sufficient evidence to show she was at fault, 100% liable and I obtained damages following a private prosecution. .......... I would rather have my health.
I'll give you that. As a cyclist I've been amazed at the lack of enthusiasm for prosecuting even filmed deliberate acts with motor cars, but there is usually some indication from the police that they are at least considering a prosecution before the lawyers get bothered about expense or effort.

I was knocked off a bicycle years ago, and the police wouldn't even do him for careless. It was July, the sun was behind him and I was wearing dayglo yellow jacket. It took the other side 3 years to accept liability.

Many thanks for your kind response.

It took me three years and considerable stress and expense to win my case. It would have been so much easier had the other driver been prosecuted.

I have received excellent medical treatment. Unfortunately, I will never make a complete recovery.

I am more fortunate than many. :A

Very true, one of my best friends since I came to UK was discharged from St George’s last week following to an accident and he was knocked off his motorbike with severe injuries. His surgeon even told him that 1 out of 4 would have died on the scene as he was flying. He was so lucky that he did not have any head injuries and there was no vehicles on the street when the accident happened that could have hit him again.

But talking about luck, I still believe that if we are good people being kind to everyone around us, God will look after us and those dishonest people will have their punishment at some point of their life.

I would like to think what goes around comes around. I try to be a good person, but sometimes it is hard and no good deed goes unpunished.

In my case, I was cautioned by the Police whilst in a hospital bed :(

Fortunately, I was able to afford a good legal team to act on my behalf.

  • Forward it to your insurer, DO NOT contact the solicitor directly, they are trying to spook you into settling the claim yourself. Same happened to my sister, she received a claim form (twice) from the same vehicle asking for 10k for a cut thumb and broken mobile screen.

Must have been a recent accident then, to have involved an iPhone X :D

I try to tell myself to stay away from the concept of "right" or "wrong" - but hey, this is soooo wrong.....

Haha, you have reminded everyone who has an iPhone X a new way of making £10K :-)

I presume you mean you took civil action against them for damages rather than you brought a private prosecution for criminal wrongdoing against them given that the purpose of criminal law is to penalise the wrongdoer while the purpose of civil law is restitution of the injured party.
