Gladstone ‘Letter Before Claim’

If the new owner exported the car, then what incentive does the new owner have to notify the DVLA about change of ownership?
The answer to that of course is - none whatsoever.
I would suggest to you that the car is still registered in your name as you appear to have not notified the DVLA of the sale.
I sent DVLA a letter on 30th November stating that it had been exported, and also gave them the new owner details etc so they would have been notified. The logbook also would have been sent off.0 -
It was sent off, or it would have been?
Any proof of posting for either?0 -

Just spoke to DVLA, they confirmed they received it and are going to send me an email with the dates of which the ownership was transferred. Would this be sufficient in court?0 -
It should be sufficient to prove you were neither the (registered) keeper nor owner
Especially i fyou have the new owners details.0 -
I'm going to fill out the SRA complaint form tomorrow also. Anything in particular I should mention or just the fact they've deceived the court in raising it against an old address etc etc?0
-
I think 'deceived the court' with evidence is all you need in the complaint.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Remind us, when is the set aside hearing date?
The hearing has been scheduled for 12th November, quite a while away!
Is there anything else anyone would recommend me doing between now and then? I assume I will receive another letter or 2 from DCBL before the date, which I will continue to ignore.0 -
Hi,
I received an email with a 28 page document from Gladstones on 28th October, I have taken photos of their bullet points. I notice they have stated that no-one will be attending from the Claimant, and they are also still saying they never received the 2 pieces of correspondence sent in January (despite me sending them a copy of the certificate of postage on 2 letters).
Is this what they would usually do, send this type of "Pre-Trial" document out? I haven't read on the forum before that this is what they do, so I am now extremely worried again that I am going to lose this case.
