Gladstone ‘Letter Before Claim’

Well that turned out to be a great success.
Walked out with them being ordered to pay £500 inclusive of the set aside fee.
Nothing for ‘post set aside hearing’ as he deemed them acting within reason but i’m over the moon with the result.
A huge thanks to all that contributed towards this, it’s very much appreciated.
If anyone would like copies of any letters or schedule of costs then please PM me and I will happily email them across to you.
Thanks again0 -
well done
looks like their advocate was incorrect then , lol
a good result0 -
Brilliant, well done. When you have descended from the cloud of success, could you do a court report- - it may help others.0

Gladstones met their match with this forum
They just need to wake up and go back to chasing proven debts like gas bills etc .... the parking scam industry is not working for them, even their own scam0 -
Would love you to describe what she said and how her face fell when she lost and heard that £500 in costs was being awarded against the dodgy Claimant.
How she lied outside the court room. What a complete waste of a law degree.

Good morning,
Court report as follows:
Upon arrival I was told by the Usher that a representative from the claimant had already arrived and that she would come and introduce herself. After 5-10 minutes she came over, introduced herself very politely and sat very close to me, almost intimidatingly close. She started straight away with my Schedule of Costs and about how because I haven't submitted a claim I wouldn't be entitled to anything and that she is happy for us to both agree on no costs and walk away at that point, with no hearing taking place.
I shut this down immediately and then posted my message on this page with regards to the claim that I apparently had to submit etc, which turned out to be false. I did notice she then sat down with another one of her cases and low and behold, he walks out the door shaking hands with her 15 minutes later, so it is clearly a tactic that does work!!!
We entered the court room and I noticed a huge change in the way she was acting. In the waiting room she was a very confident figure, walking around and talking to people, very chirpy and to the point. Once the judge was talking, she was stuttering quite a lot, and was repeatedly talking over the judge, something he did not take very kindly to. She had my entire pack in front of her but hadn't done her homework and couldn't answer any questions he had. She kept going back to what they had done and sent out, which was ultimately incorrect, which led to the false issue of the CCJ in the first place.
The judge stated that I had done above and beyond what is expected of a litigant in person in preperation for the set aside hearing that had already taken place, and was very surprised that the previous judge had reserved costs and not awarded them previously. He admitted this was a mistake and then proceeded to award me the set aside fee, the travel/parking costs and also the time I had applied for at the litigant in person rate.
We moved on to this costs hearing, and he was unsure as to why the claim had been dismissed a couple of days prior as he had photos of the original parking issue from 2015 and said I was in the wrong, and had it not been dismissed then they would have had a claim against myself. He asked the solicitor why it was dismissed and she said she does not know. He then proceeded to state that he feels it was dismissed at such a late stage as to try and get the defendant to "buckle" and not go ahead with this costs hearing, knowing full well the defendant as a minimum would be awarded the set aside fee.
Unfortunately the judge felt that they had acted "reasonably" from the set aside hearing to now and didn't award any costs for this hearing or preparation for it , but I was more than happy with what had already been given for the set aside etc so didn't argue too much.
I would like to thank everyone that has contributed to this, I have learnt so much from the time spent researching, and am willing to help anyone going forward. I have sent my letters etc to a couple of people who have asked via DM so feel free to ask and I will send any bits out and answer any questions you may have.
Good luck to all in future disputes0 -
