    Oh yes I will definitely be requesting a hearing. I'm very confident of winning, and won't be taking any offers from them either.
  • Evening all,

    I received a response today from the county court stating in caps that I must file a C.P.R compliant defence to the claimants claim.

    I believe I have already done this, I have sent a breakdown of what has been sent by who, and then 2 pages of why I believe the claim should be dismissed.

    Any suggestions?

    Is your Defence CPR compliant?

    You have not shown us your Defence so it is difficult to comment on any possible weakness.

    It is good to see the the court has given you an opportunity to improve your Defence. What date do you have to produce that Defence by?

    14 days from the date of the letter, which is the 19th of December.

    I could upload a PDF copy via the internet for someone to proof read if that was possible?

  • Is there a specific set of guidelines as to how to formally set out a CPR compliant defence? What I submitted was set out very similar to something else found on this site.
  • Bump. Would be looking to rewrite the letter on the 28/29th so any links to how to set the letter out would be grateful.

    Have you seen all the guidance about how to write a Defence in post #2 of the NEWBIES FAQ sticky thread?

    Many examples there.
  • Sorry for the delay in response, haven't been able to get to a computer over the Xmas period.

    I wrote my defence based on one of those found in the NEWBIES FAQ which is why I am confused as to why it needs to be changed.

    I have the statement of truth, correct claim number, previous cases referenced etc, only thing I can think of that may need sorting out is referencing to the original claim?

    What if I was to submit a Form N9B, would that suffice?

    I had a look at some more defences and I think my numbered paragraphs were too long, so I split them down and sub numbered, so hopefully it's now correct.

    Will update if there's a response, and can also post an example if they accept it to help others in the future.

    Afternoon all, thought i'd provide an update as it's been a while!

    We have a court date for this which is early September, and i've just had a call from G'stones asking if I would consider early settlement. I replied with possibly just to see where he was going with it.

    He said original amount is 280 and they'd settle on 170, with my response being, you want me to pay 170? No thanks, will see you in court :D

    I expect another call or 2 before the court hearing, but I look forward to hopefully bringing you some good news and can then advise others of how to beat these!!
