Help on stopping in yellow box fine??

Hiiiiiii
Today I was turning right at a cross junction in cardiff when I was cut up by another driver and was left in the middle of the yellow box and have ultimately got a fine as this box has cameras watching it. There are 2 lanes which allow you to turn right and I had my indicator on to show my intent. However on the road I was joining there was only enough space for 1 car (in my lane) and another driver pulled right across me and forced me to blast my horn and swerve out of the way to avoid hitting them! This left me in the box by a cars length and blocked traffic to the left of me from driving. My partner took pictures of the cars and it's numberplate whilst I wrote up a quick statement of what happened whilst it was fresh in my mind once i had parked. Will this, along with photographic and video evidence caught by the cctv camera, be enough to counter the fine and have it removed?
Really need another opinion...

    If this happened today, how have you got a fine already?

    Perhaps worth waiting to see if one is actually issued.
  • You would probably be better off posting on Pepipoo.com about this - there are tricks to Council appeals.

    You need a much clearer description and a Google street view of the junction and lose the drama - no one forced you to sound your horn for example.

    The council presumably has the complete sequence of events to view and should be able to judge whether your driving was appropriate. Councils are required to be reasonable so if you can show your exit was clear as you moved off and then someone obstructed you you should have a case.

    If there are two right turning lanes then there must be two lanes exiting, it is not clear from your description but I assume you are saying that only your lane was clear and the person in the other lane switched to grab the space rather than block the junction.

    Your description is not the clearest, but from what I think you're saying, you were turning right at a box junction, but were prevented from clearing the box by another vehicle also turning right?

    Remember what HC174 says...?
    However, you may enter the box and wait when you want to turn right, and are only stopped from doing so by oncoming traffic, or by other vehicles waiting to turn right.

    If you aren't saying that, then perhaps you could clarify? If you are in breach of the box junction, then saying "But the other car did something naughty" is not mitigation.

    If this is the case then an appeal should succeed. Try Peppipoo as suggested. (Post in the Council Parking Tickets & Clamping and Decriminalised Notices forum) Generally, as well as scanning the PCN you will need the video footage, which should show that your exit was clear when you entered the box, and that the other car manoeuvred unexpectedly into the space that you had a very reasonable expectation of being able to occupy.

    The PCN will only show you stationary at the end, which is a bit naughty, as they should show you entering the box too, at which point you would see that your exit is clear.

    The council usually folds if you opt to attend a tribunal, even if they dismiss the first appeal.


    Next time, stamp that accelerator into the carpet and get there first ;)
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    If my interpretation of the post is right, then I doubt one will even be needed. It's only just happened, and the OP is assuming they'll get a fine simply because of the cameras. Nothing's been received yet.

  • A family member was fined not long ago for stopping in the same box so I'm 99.9% sure I've been fined...

    Which road were you on and heading towards (i.e. North) and turning right into which road heading where?

    Ok wait 2 weeks to see if you get a ticket.

    Am I right, forum members, it will be within 2 weeks just the same as an speeding NIP?

    Also forum members when you request the video from the council:
    * Do they have to supply it?
    * Can they make a charge to supply it?
    * What format is it usually sent in?

    If turning right, you are allowed to enter and wait whilst making your exit is blocked by oncoming traffic or by other vehicles in front of you who are also inside the box waiting to turn right.

    You are not allowed to make the "turn right manouvre" if your exit is not clear and end up stopped in the box blocking traffic.

    As the OP said "blocking traffic from my left"
