    What, thats nonsense.

The fact is youre not allowed to dispose of someones property without their permission.

You wouldn't be pleased to find four tyres in your boot after a change.

As has been said a mistake has been made.

If I was the OP I would try twisting their arm a little more but if two were old and two new cost price + fitting is probably a fair compromise.
  • It is pretty normal for normal tyres to be kept when fitting winter tyres - the only time I'd say it might be reasonable to dispose of summer tyres would be if they were completely worn out. I would be expecting them to be returned or stored (at a cost).

However, as an error has been made, the garage appear to have made a reasonable offer. Unfortunately, in the small claims court, they would not view it as the garage's responsibility to put you in a better position, simply to make sure you had not been disadvantaged. This can have the effect of emptying your wallet in the short term, but over the life of the tyre you should consider whether you are in a similar position.

I have successfully argued for a complete replacement carpet as I argued that we had no intention of replacing a bedroom carpet with a 30 year lifetime after 8 or so years when they tried to make us give a contribution over a workman's paint disaster. I don't think that is reasonable in the case of tyres that wear out in a handful of years.

So, work out whether you are out of pocket in a couple of years. If you are, argue your case, if not, smile, make friends and you might find that the garage is thoroughly embarrassed and glad to make the best of a mistake and will look after you better in the future.

When you have new tyres fitted you always make a point of telling them they are your property and that they are allowed to dispose of the tyres?
When I have them changed, they always ask me if I want to take the old ones or pay £1/tyre for disposal.

It's far MORE normal to just have the wheels swapped for a spare set with the winters fitted to them.

Fitting four tyres into the boot is rarely particularly easy - it requires a big boot and/or fairly small tyres. Mostly, they'd go in vertically, which would require the parcel shelf removing.
  • Never had a garage ask if I want them disposed if, they just do, without charge either.

I've never been asked, but always charged. The garage have to pay to dispose of them, so they simply pass that on.

A simple human error has been made - garages simply aren't used to removing tyres from rims then giving them back to the owner, because 99% of removed tyres are knackered.

And they will charge for disposal. If these were almost new; no mechanic/fitter would let them be disposed the same way as a bald tyre.
The mechanic/fitter will have put them to one side for a mate.

The OP fell for it too, way too trusting.

An extra £70 on top of the expected £20 fitting free for a set of new summer tyres isn't a bad deal considering the ones which were accidentally disposed of would have been part worn anyway.

It really depends on what brand/model of tyres they're proposing to fit at "cost" price ... my guess is ditchfinders.

OP - it's FAR easier to just buy a second set of rims for the winter tyres.

That's what I do. Takes me about an hour to do myself and fortunately I'm a robust enough lass with some weight behind me and wood-burning stove muscles!
