garage disposed of my tyres.
Got 4 new winter tyres fitted other week. i asked garage what i did with my normal tyres, he checked them and said they were all fine, he would put in my boot and just to store in garage . two of these tyres were new in march. got my new winter tyres on, drove home. needed to sort my garage out so didnt check my boot. nearly a week later i opened boot, no tyres. rang garage said the tyres have been disposed of, best they can do is give me 4 tyres at cost when i want them swapped back. so what should cost me 20 pounds to swap from winter to normal is now gonna cot me around 90 pounds. do i have any right to ask for tyres for full replacement cost.local independant garage.

The obvious thing to have done was confirmed and checked with the garage at the time that they had put the tyres in the boot of your car before you left, but as it was a week before you enquired about them it is not unreasonable for the garage to assume they were not wanted and disposed of them.0

The fact is youre not allowed to dispose of someones property without their permission.
Id be asking for four replacement tyres at their expense or they will have to argue it in court.0 -

Garage has already disposed of them and they have said this so how can the OP be trying it on?

First let me say that I think the op is telling the truth and I believe he was given the disposal explanation verbally and I believe the garage did say that.
However, if the op decides to pursue the course advocated in the post I replied to what would stop the garage denying the content of the phone call and saying that they did put the tyres in the boot?

I think you should ask the garage to fit four new normal tyres at a cost that reflects the fact that they incorrectly disposed of your originals but also takes into account betterment - in other words, you should make a contribution to reflect the fact that you’ve lost four part-worn tyres and gained four brand new ones.0

Nobody said otherwise.
A simple human error has been made - garages simply aren't used to removing tyres from rims then giving them back to the owner, because 99% of removed tyres are knackered. They did what they normally do.
If the boot had actually been checked - before leaving the premises - the error could have been quickly and simply rectified. But a week later...? Nah.
And that's if the garage definitely recall the tyres being binned rather than put in the boot, rather than wondering what happened, but deciding to just offer the at-cost replacement as a nice simple way to sort it.Id be asking for four replacement tyres at their expense or they will have to argue it in court.
The value of four part-worn tyres is what is owed. No more than that.
OP - it's FAR easier to just buy a second set of rims for the winter tyres.0 -
Thanks for your replies, yes i was daft not to check the boot but it was dark and i just presumed they would have done as they said. I was getting work done on my bathroom and garage was full with things from that, hence why i didst try and take them out of the boot or check earlier. next time i would def check. looks like the cost is going to be down to me. just annoying because two tyres havent had much wear as were replaced at mot and i dont do many miles.wendy x0

So it is nonsense to open your boot and check the tyres are there before leaving the premises.
When you have new tyres fitted you always make a point of telling them they are your property and that they are allowed to dispose of the tyres?
They have already made an offer to replace four part worn tyres with new ones at cost price, but you would rather take them to court.
