Carphone warehouse

Hi all, yesterday i went in store to upgrade my daughters iphone as she is coming to the end of her contract. Went for an iphone 6,£29 pm, 3 gig of data....all good. The sales person said there was none in stock can i collect the next day, yep no problem.

Went in the store today & picked up the phone, got it home & it was a "refurbished" iphone 6, no box, earphones etc just a charging lead & plug. At no point in the sale was a refurbished phone mentioned, so i returned to the store complaining only to be told to come back tomorrow to see the manager (who sold it to me)

Where do I stand? Should they issue me a new phone, or can i cancel the contract within a cooling off period?

Just wanna be "prearmed" so to speak.

  • The iPhone 6 isn't a current model (6s is), so not sure why you thought you would be getting a new one. Saying that they should have made you aware.

    Chances of getting new one is slim, so cancelling is probably your best option due to lack of information.

    What does the contract you signed say you were getting?

    The iPhone 6 is getting quite old now, I’d be surprised if they still had new stock to sell as they were discontinued over a year ago. The oldest current model is the 6s.

  • There's no cooling off period unless CPW have it in their t&c.

    You should have been made aware it was refurbished, though if they didn't claim it was new you would have a problem.

    Having a quick look at CPW, and they do still show new iPhone 6 available, I’m assuming OP is on o2, there is an upgrade plan for £29 for 3GB, this is listed as with a new 32GB iPhone 6, deal is shown with a 64GB iPhone 6 refurb as well.

    As I said above, the 64GB would be a refurb, the new iPhone 6 is 32GB.

  • Bearing in mind i'm not "tech savvy" still, the point was at no time did he say it was refurbished & I wouldn't have had it if he did say.
    So I'm saying what are my options before I go in & speak to him? make's me wonder if they are pushing the "refurbed" models.
