Don't be so silly, I am going to work..... And looking forward to it.and when I left work I knew I had another job ..... This problem is short term as the debt is paid out of my last salary.... Think b4 u write... The problem is for the Xmas period.... It's just unfortunate I couldn't take anymore !!!! at this moment in time , had it have been after Xmas there wouldn't be an issue , I would be working n only having one,,, yes one day of unemployment. Oh ... God forgive me for working for 25 yrs n having one day of unemployment. How many have u had?
The prob is simply because it's Xmas n I have accrued no holidays for the period over Xmas....il get over it...0 -

I had entered into cycle to work scheme with prev. Employer as I cycled and no intention to leave until this manager tipped me over the top.
They agreed to pay me my weeks notice so they only owe me Half a months salary around 760 pounds. The bike was 990, I only paid 2 instalments, 110 pounds. 990 minus 110 = 880 owed. I guess it will be the gross pay they will use to deduct all they can. Therefore what happens to the tax side of the paye for this month..? And I go on weekly salary starting from Monday . 365 per week gross. So in effect I have no earnings to live on for my first 2 wks of this month. Also I have no holiday pay for the 22Dec to 2 Jan , due to Xmas. I am in housing assoc. flat. Can I claim any benefits.... To help me over this short period until I get rolling from the 2nd with continuous temp contract?
I am very confused been in continuous employment for over 25 yrs. no benefits don't know where to start .
Please don't say why couldn't you stick it until after Xmas , don't want to go into it it was unbearable.
To claim HB/CTS you will need to submit a claim form and the starting date will be from the Monday following receipt so if submitted today then the 11th.
This the same day as your new job so the wages will be needed to assess the claim so no payments until the wages are received.
It will go back to the 11th if you qualify.
If you give them the old wage only certain deductions are allowable eg NI, tax, expenses incurred for the job etc not deductions for bike payments owed -
but as this wage is for the period before claiming it won't be taken into account anyway.
A P45 will be asked for as well.“You’re only here for a short visit.

ESA is NOT an "UNABLE TO WORK" benefit, and may be retrospectively claimed for a past period.
ESA is a benefit for a limited capacity to work, in the initial stage of ESA a claimant need only show they have a medical condition and supply medical evidence of such. A self certificate is legitimate medical evidence.
ESA claimants can work part time whilst they are claiming ESA.
ESA claimants can go back and forth between claiming ESA and working full time IF THEY WANT TO and as many times as they want to.
Mortisha, this is an internet forum and like virtually all internet forums you get people who want to help and people who only want to judge others, and those latter types generally also show their lack of knowledge of the subject matter.
Good luck to you in whatever you decide to do.0 -
You are advising someone to commit fraud. They are not sick. They have not said that they are sick. You are telling them to lie and say they are sick to claim benefits to which they are not entitled. This is the kind of behaviour that promotes the misconception that benefits claimants are all scrubbers who lie about their medical sickness. The easiest benefit for you to claim is ESA Conts, if you have full time worked for the last 25 years you will get ESA Conts no problem.
Your first period of unemployment is
Thursday 7th December - If the 6th December is being counted as a day of employment. until Sunday 10th December.
You don't need a sick note (ESA is a benefit for those with a medical condition, and requires medical evidence after the first 7 days) because the period is less than 8 days.
You won't get JSA (looking for work benefit) because you gave up your job.
The first 7 days of benefit are not paid so you won't be paid anything for 7/12 - 10/12 But what you will have gained is 4 days of waiting used up...so when you claim ESA Conts again on 22/12/17 you will only have 3 days of waiting left
you won't be paid for
22nd 23rd 24th December but they will pay you £73.10 a week from 25th December - 1st January inclusive. which will be £83
When you claim from 22nd December you will again have a self cert sick note for 7 days, but you will require a real sick note from 29th December for 7 days or from 22 December for 2 weeks.
Or if you don't want to get a sick note just claim on the 22nd you won#t need a sick note for the first 7 days, you can close the claim from 29th and they will pay you £40 without having an actual sick note.
It should not be any problem getting a 1 week or 2 week sick note based on your stress that the previous manager caused you. But with doctors waiting times you should phone them now and ask for an appointment on 22nd - 29th December
ESA claims can be backdated, so you can claim on Monday by phone for those dates, and make sure they write down on your claim records that you are now back in work and you are only claiming for those 4 days. They might try to dissuade you from claiming because you won't get anything for those 4 days ...but just ignore them and tell them you want the claim to go ahead to use up your waiting days incase you have to claim again in the next 12 weeks...(which you do and will do but you don't have to tell them that you intend to claim again from 22/12/17)
To make the claim phone 08000 556688 and choose sick ness benefit...then say you want ESA Conts only... if they say you are in a UC area..take the phone number from them, phone UC, and INSIST on claiming ESA Conts New Style through them...DO NOT claim UC.
A self certification is a "real sick note" - if you lie on it and get caught, there are consequences. If you lie to the DWP and get caught, there are consequences. Are you willing to take on those consequences for the OP if they are caught out following this advice?0 -
I am a bit of a lurker in these forums but i felt i had to post.
Epitome, i have no doubt of the great knowledge you have regarding ESA and the many times you have helped people...BUT...you are effectively advising someone to commit benefit fraud.
Stating 'ESA is NOT an "UNABLE TO WORK" benefit'......not so sure the government would agree.
The OP had never mentioned being stressed until you brought it up.
Indeed the OP is leaving one job & subsequently starting the next.
To suggest they may feel stressed at the end of the month from their previous job ......have you got a crystal ball?
Think you may have lost a lot of respect from others on here regarding your post.
You seem so caught up in your knowledge of ESA that you have imparted a way for anyone to get some free money from the government.
If you are a DWP employee i would be careful0 -

Exactly this
You're also advising somebody to waste a GP appointment at a time when believe me GPs have more than enough to do0 -
I really don't think anyone can judge on here.... It has made me ill....working in that place... And the person saying I am wasting GP time, wasting time claiming benefits... Well really I was only asking for advice in an area I am not familiar with. Feeling in a mess not because I left my job through choice... It was making me ill working there....
It is not for anyone on here to be so absurd to think that only their opinion matters, we are not all sheep and we are not all wolves. But, one thing ... We all have choices and I chose not to stay somewhere that would have without any doubt made me very ill... So before that happened i got out and yes I have worked all week and guess what .... It's so much better where I have gone.... Now go and judge somewhere else..... There will be many you can prey upon and demerit and run down and make them feel worse. At a time like this there are so many suicides going on think before you judge....people are only trying to help!
So unemployed 2 days .....judge me !!!
What if I was suicidal... No I didn't put it on here and probably wouldn't. And I am not... But some on here have been like vultures! Waiting for some person who is wounded .... To drive even further down than they are feeling!0 -
Also for the record they are deducting all my wages £700 approx gross pay to pay for the bike, prob leaving a balance of £200 owed. So I will have no pay come next Friday, but most of my dues paid.0

Mortisha I think you've misunderstood, a lot of the comments, mine included, are referring to Epitome's advice to you, rather than to you, because it was advising you to commit fraud - which you were clearly not intending to do but is what the advice constituted.
Glad that you're enjoying your new job0 -

Did you use up every shred of leave in the last job?
I received the last 'payslip' and further to what I thought deductions just made out of that, otherwise it looks neat considering when I left I was told I'd have owed them - got £50 odd paid out even which wasn't expected. Lesson definately learnt why to retain annual leave.
my temping job then turned into weekly paid (bar the week in hand setup when monthly had just been presumed) and suddenly it didn't look such a hole. If you are temp to perm, I wouldn't see the issue in asking for an agreement based on your intended longevity or offering to change notice period term in exchange for covering being paid the public/bank holidays on this occasion.
I'm not judging but this could be a better position then you think.0
