I phoned the court to inform them that the first defence statement was sent in error and retracted by email on the same day. She said that they had one on file but she couldn't see which one so is sending to me by post so I can see. I will phone them once that's been clarified and ask them why they have accepted a document that is clearly in the wrong format and doesn't have my address or anything relating to me except my name. I'll update next week.

Any further advice on this, I have now been formed by the court that my original defence statement in the wrong format and with inadequate defence has been sent to gladstones and N180 has been forwarded on to me. I am still working away from home and my daughter has informed me there is mail from the court for me. Presumably I follow the procedure outlined and request a day in court. It might be tricky getting time off work for this as I teach but am advised this is better for me. Do s anyone know much about asking question regarding gladstones representatives 'Is the representative awarded right of audience according to order 1999?' ? I'm also unclear about skeleton defence and witness statements although I have been trawling information that on here. Any quick answers would be appreciated.

Not sure what you mean and what 'roa' is. There are so many acronyms.

ROA = Right of Audience. You mentioned it first.

You need to send gladstones your real defence, explain8 g the mistake. Otherwise they’ll crow about it on the day.

Hi, after taking your advice about sending them the real defence, I have received two email from admin assistants at Gladstone's. One saying they will submit it as a witness statement 2 weeks before the case is heard. The other one says the following:

We act for the Claimant and have notified the Court of our Client’s intention to proceed with the claim.

Please find attached a copy of our Client’s completed Directions Questionnaire, which will be filed with the court upon their request. You will note we intend to request a special direction that the case be dealt with on the papers and without the need for an oral hearing

This request is sought simply because the matter is in our Client’s opinion relatively straightforward and the costs incurred by both parties for attending an oral hearing would be disproportionate.

You will note our Client has elected not to mediate. Its decision is not meant to be in any way obstructive and is based purely on experience, as mediation has rarely proven beneficial in these types of cases. Notwithstanding this, our Client would be happy to listen to any genuine payment proposals that you wish to put forward.

I informed Gladstone's that I will be requesting my day in court and not the paper route they wanted. I find the last paragraph interesting and wonder if there is any point in offering something without an admission of any guilt. I also realise that they were not offering this before so think they are perhaps bothered by my defence.

WS - do you mean your request for docs has had the usual template stating they won’t send them yet? I’d include this refusal in your witness statement. This completely fails the overriding objective.

No, this is their standard template DQ Response. You will see that you supply a covering letter to the court, with your own n180 - check if this has been sent, log on to mcol. Or just download your own...

Hi, I think there has been a N180 sent to me via my daughter's address which I presume I need to complete. Gladstone's N180 has been completed and I have a copy of it. Do I send a statement letter with it my completed form?
Gladstone's wording on the email was 'witness statement' I have informed them that the one I sent to them yesterday is the correct defence statement and the first one was sent in error. I have also informed the court. It's become a little complicated as the court sent my first incorrect statement from 8th which was in the wrong format and they have me that they will look into it and let me know what they decide to do.

I'm getting tied in knots so not sure what you'll make of it all.

8th Dec, sent first defence statement copied from internet in haste, retracted it straight away and italso was sent as a photograph, not PDF so not sure why the court accepted it anyway.

13th Dec, sent court correct one and received an email to say they had already received a defence statement.

Phoned the court on 15th Dec and they said they'd send me a copy of the one they had forwarded to gladstones. I received this and it was the first and incorrect one.

I sent a copy of the correct one to Minster baywatch and Gladstone's this week. They sent the above emails back stating they would send my 2nd defence statement as 'a witness statement 2 weeks before' the court hearing. The second email is the one I've copied and pasted.
Also how do I get back onto the mcol?
I've made a note of the gateway number but not sure how I get back into it or if I need to as it all seems to be phone calls and snail mail atm.
