Ok, I've looked at the defence statements on various other threads and come up with the one I've sent. Could anyone advise me whether it is sufficient or do I need to add anything else? Also, does it need to be sent to the court within any particular time frame, I have read the info and know I've bought myself 28 days.0

Hi, my posts don't seem to going on here anymore.0

Hi,
Can anyone see my posts? I don't seem to getting a response.0 -
your posts are working just fine
BUT , there are few legally trained people on here , those who are have jobs to do and any help is given voluntarily in their free time , plus there are far too many court cases and this forum was not set up for court cases, it was about parking tickets etc
so yes your defence needs checking by someone qualified to do so
I am not that person so refrained from replying as you need proper legal help
I hope that explains it ?
ps:- you say you have sent the defence , then you are asking when to send it, you cannot have done both
the defence you have posted on here has only gone to here
you dont send the court the defence until its been approved on here
it also needs printing , signing and dating , scanning back to laptop and saving as a signed and dated pdf , BEFORE sending to the CCBC email address as an email attachment
you cannot submit an unsigned and undated pdf to the CCBC
the alternative is to write the approved version on your defence document , sign and date it and send it by post by getting a free certificate of posting from the P O Counter
there is a date of service on the MCOL you received, add 28 days onto that date to get your deadline date
if in doubt , ring the CCBC and ask when that date is0 -
Hi, sorry, I'm a bit of a digital immigrant and couldn't see the posts properly for some reason, just a message telling me I'd posted 10 times, not having a go, I realise people have busy lives. My defence document was copied from another site , bmpa support and I asked the court to ignore/retract it once I'd seen your message, so hopefully they will do this. I've done a final copy of the defence statement but am totally illiterate with matters of the court or law etc. I appreciate the help but it's still confusing. I did the AOS online ne but don't recall seeing a specific date but that doesn't mean I didn't get one as I didn't know what I was looking for on the gov website. I did this on Friday 8th so am presuming I have 28 days from that date but will contact the court. Can I ask what a skeleton or witness statement is? How do I defend myself in court with no training in law? Apologies if my questions are not directed towards in the right area as I realise you folks are doing this in your own time.0

When you acknowledge service that gets you 14 extra days to submit the defence.
So you have 28 days from the date of service NOT the date you did the AOS0 -
Is date of service the date the form got to me? I have only seen a photocopy as I'm still working away. So I get 28 days from 4th Dec? 14 days to submit defence from 8th?0
-
I did tell you that the date of service was on the MCOL you received, so you need to check the photos of the paperwork that Northampton CCBC sent to you , check the date of service and add 28 days to that date
so if the date of service was 4th dec, add 28 days on to it , making it say the 01 jan 2018 , so maybe aim to get it in before december 30th
and you could phone the CCBC and ask when the defence has to be in by
the NEWBIES sticky thread post #2 has a timeline and examples of various things you need to do and when
research is the key to this and being the small claims court you have to do this by yourself, with help from others I agree, but you are the one driving this and you are responsible for getting up to speed and defending yourself
its like your university course, you do the research , the work and the exams , the lecturer wont do it all for you
same thing applies to your driving test, you could do the research yourself, drive your parents car with them in the passenger seat, take the theory test by yourself and go and take the practical driving test by yourself , without any input from the examiner or instructor
nobody will do this for you and that is the thing you need to know and understand, so the more research you put in the better the outcome might be0 -
Thanks for the advice, the unfortunate thing is my stress levels as I've got so many deadlines looming, and yes, they are all research based so I know how time consuming this could be potentially. Think I may have bit too much off here even now. I work full time so doing all of this might just be an impossible task for me. Appreciate all your help as I said but it's a matter of £250 or a minor mental breakdown as dramatic as that sounds.0

for now all you need is a decent defence sending in before the end of this month
then you can relax for a while until MB decide if they are proceeeding to the next stage and pay their court fee
any court case could be up to 6 months away
so if the defence on page 1 is approved by somebody on here, just print it , sign and date it , scan it back to a pdf and email it as a pdf attachment to the CCBC
not too much to do at this stage once the defence is sorted out
people here will help you along the way0
