UKPPO and BPA

My daughter got a windscreen pcn from UKPPO for not parking in a designated space for work. Anyway, the signage clearly shows two BPA logo's.



BPA have told me that UKPPO are NOT BPA members.


I appealed after the 14 day period with this....


Dear Sir/Madam
Ref: xxxx
I am challenging this parking notice.

It states that the vehicle was not parked an allocated Xxxxx space. The vehicle has a valid permit. A copy of the permit is enclosed.
If you reject my appeal. As you claim the signs form a contract, by showing BPA ATA membership you are contractually agreeing to provide POPLA as the Alternative Dispute Resolution, so please, send me a POPLA code.

Dear Sir/Madam,
Thank you for your communication regarding the above Parking Charge Notice (PCN).
Please be advised that the time in which to submit a challenge has now expired and access to the Independent Appeals Service is no longer available.
However, in order to resolve the matter, I will offer the following comments as to why this PCN was correctly issued and is still payable:
The site in question is subject to terms and conditions, which are stated on signs throughout the area. Those signs clearly state: “All Vehicles Must Park Within Their Correct Allocated Bay Only”.

My simple appeal within the 14 days was a certain cancellation. But now its got a more complicated.

Where do I go from here?

I have taken photographs of the sign with a date stamp, just in case they change the signage.

    Nowhere. There is no merit in appealing further as they won't listen so sit on your hands and don't tell them who was driving.

    They are not BPA ATA members but may be members of groups there. They joined the IPC ATA on 19/11/2015 (https://theipc.info/aos-members/u)

    I appealed neither as the RK or driver.

    I've read that UKPPO doesn't currently do court, but 6 years is a long time to sit tight.

    I wonder if they'll have the cheek to continue by sending a NTK

    Do you have photos of the signs that show BPA membership? Should this go to court, you might need this as evidence. It’s no good going to grab photos in 4 or 5 years time!

    Remember that the BPA logo enclosed in a rectangle just indicates a membership of a general nature rather than being an Approved Operator (the dangerous variety which can access DVLA data and issue parking charges) which is depicted by the BPA logo being enclosed in a roundel. If it’s the rectangle, it doesn’t help your case at all.

    You’re nowhere near defence stage, so for now gather what evidence you can, then sit back and wait. There’s nothing you can do to short-circuit the 6 year limitation period, other than to pay (no one here recommends that course of action) or get hold of the landowner and complain and see if they will intervene.

    they may well be BPA corporate members and use the corporate logo, but not the AOS logo

    Complain to David Dunford of the DVLA and ask him to investigate this urgently. They are breaching the Consumer Protection Act by purporting to belong to a trade body when in fact they are not. Ask him why the DVLA released your details to an organisation who were/are in breach of the law.

    You must also formally involve Trading Standards and refer them to this recent case where their counterparts in South Wales successfully prosecuted another PPC over the exact same contravention.

    they left the BPA 19/11/2015, this is 2 weeks short of 2 yrs ago HOW repeat HOW can the IPC have audited and accepted the signage !!!
