Daughter not received wage

You'd probably be better posting in the employment board.

Ypu could try and email the chief executive, he has a team or at least a pa that might deal with these things, wouldn't be good PR for a large firm.

Maybe contact your MP?

    Timely payment of wages is of course a fundamental part of any employment contract. However, it is unclear what actually happened here.
    I would caution against making too much of a fuss with a new employer especially when it comes to accusing them of theft.
    What degree of inconvenience has your daughter actually suffered because of this?
    The best thing your daughter could do is to speak politely to her line manager or somebody in authority at her place of work and explain the problem and that it is causing her a lot of problems. Has anybody said when the money is now due to be paid? Could she claim something like no money to buy tickets to get to work, no money to eat etc to try to get them to give her an advance?
    Non-payment of wages may well be theft under Scottish law. However, I would imagine that the police would not have any interest in prosecuting something like this. I would imagine that this has not yet even approached the criminality threshold.

    Do you know what has actually happened?

    For example, has the company sent the money to the wrong sort code and account?

    Or, has the company sent the sent the money to the correct sort code and account, and it hasn't arrived?

    If it's been sent to the wrong sort code and account - does it look like a typo - e.g. one digit wrong? Or is it completely wrong info?

    By finding out this kind of stuff, you might be able to persuade the company that it's their fault.

    At this stage I would not advise anyone to start talking of theft.

    Have you found out the bank details the company has on their system?

    Was this a paper form she filled in, or was it some electronic method?

    If it was a paper form then ask the company for a copy of the form that your daughter sent them.

    If electronic then they will also likely have a record of that too which you can ask them to access. Maybe your daughter has access to it too?

    If it’s not causing financial difficulties then just wait for it be sorted. If managers are chasing it then there’s nothing more to be done at this stage. Pay being messed up at the start of a job is incredibly common.

    If it is causing genuine difficulties then my advice would for your daughter to speak to her manager again and say it’s getting urgent because of x, y, z. I’d advise her very strongly not to mention theft(!!), anger at her treatment, or legalities. It’s perfectly reasonable for her to say politely but firmly that she is absolutely certain this is not her mistake. Anything beyond that will be counterproductive.

    Payroll dept refusing to answer either daughter or her bosses re exactly what mistake has been made, they simply keep insisting she gave wrong info which I know she didn't. Info was submitted electronically she does not have access to check.

    Bosses have been chasing too to no end also being given runaround by payroll dept. They believed initially it would be sorted within a few days.

    It is leaving us in genuine hardship. She gets a lift to work but in a few days we are going to be really stuck.

    In addition it is causing us both sleepless nights. Both suffer from anxiety this is obviously really not helping.

    They're basically saying that they have no obligation to pay her until they have the funds returned to them by the bank.

    Im guessing theyve paid the money in to the wrong bank?

    Im assuming they have some kind of paperwork to collect personal information including bank details. It would be handy if you can see this to confirm the correct details where added.

    You need your daughter to go in and speak with them. Find out exactly where the mistake was made. If definitely not her fault state that as they have breached contract for failing to pay in the relevant pay interval you will be forwarding any direct out of pocket expense to them (that is things like overdraft charges if applicable, missed payment fees etc, not the like of sleeping tablets of anxiety pills, youll probably need to provide proof of any expenses so bear that in mind). That should hopefully encourage them to pay as quick as possible.

    You need to be sure its their fault though.

    Payroll's refusal to clarify what has happened is really very strange.

    Has your daughter asked for confirmation that the money was remitted to her account ** ** ** xxxxxxxx?


    If it was, then she should ask for the date of transfer and check with her own bank.

    If her bank say that the money was not received, then she asks Payroll to request the company's bank to trace the payment.

    If Payroll say that the money was not sent to ** ** ** xxxxxxxx then clearly a mistake has been made.

    Either your daughter miskeyed her account details or Payroll did.

    You need to establish which.

    Either way, she wants future payments to go to the correct account so the matter requires urgent clarification.

    They're now saying it could take ANOTHER 10 working days to sort and that she has to provide proof that she's not been paid - which they have NOT mentioned before.

    Did they say why it will take 10 days to sort?

    If there waiting to recieve back a payment sent in error, it can take much longer than 10 days. I put an application in start of october and its not been refunded yet.

    Tell your daughter to take a bank statement in from the bank she gave the details for showing no payment. If theyve paid to wrong account, they should pay your daughter immediately.

    A face to face meeting will get this sorted a lot quicker than phone calls.
