Just had a read of Newbie's thread and wanted to make sure that I understand it correctly.
So I gather that appealing to IAS is a waste of time. If so, Redx in post 13 above said 'appeal , IGNORE , complain to Managing Agent and/or LANDOWNER' so who is this appeal to? Also, who is Managing agent?
My biggest worry at this point regarding 6 years is that if I leave UK with work within next couple of years, (applied for jobs abroad), and they decide to take me to court etc. can it mess things up in my absence, as there will be no one to respond to those court action letters from PPC/Debt Collectors etc.?0 -
the initial appeal always goes to the PPC , which in this case is VCS
IGNORE is ignore the debt colelctors
if LIDL own the car park , then the complaint goes to them
if they are renting it from a MANAGING AGENT , then the complaint goes to them
it may also be the case that a landowner complaint is also made , as well as to the MA0 -

If you leave the country and this is still unresolved you write to the PPC and give them your new address for correspondence in whatever country you move to. Make sure you keep proof of posting and a copy of your letter to them safely.
If in the event they ignore it and press on with it via court and gain a default judgment, you will be able to apply for a set-aside on return. Your credit score might be affected, but as you’ll be abroad you’re unlikely to be applying for UK loans or mortgages.

Not hypothetical, I have been seeking actively for work abroad. Hence the question needed to be asked as its very relevant.Your credit score might be affected, but as you’ll be abroad you’re unlikely to be applying for UK loans or mortgages.
This worries me a lot actually. Who knows in what circumstances (if I do go abroad for few years) will I return to the UK. You always like to keep your options open especially with credit availability.
I am only renting in the UK, I will be moving with family if I do. I will have to put the divert on my post to one of my friends/relatives. Must admit, didn't think of post as most of dealings these days is via emails.
Ive read somewhere on this or another forum that VCS aren't keen on courts. If its true or not, what are my chances of landing with a default judgement in my absence in this case? I need to decide now only on the basis of this. If I guaranteed to be in the UK for 6 years, I wouldn't even think about paying to these crooks but didn't think of move abroad until yesterday!0 -

If VCS lodge a court claim and you don’t defend it, the chance of landing a default judgment is virtually 100%what are my chances of landing with a default judgement in my absence in this case?
There’s no guarantee this will end up in court, and in your shoes I’d delay doing anything precipitate until you know for sure you are moving abroad. Then you write to VCS and tell them formally that your new address for any further correspondence concerning your case is ..... (1, Acacia Avenue, Timbuktu - or wherever!), and you obtain a free proof of posting certificate from your Post Office counter and you keep it safe, with a copy of your letter, for 6 years.
You could also provide them with a SAE (cross refer to it in your letter) to confirm back to you that they have noted your new address. This will be vital in case they ignore and go for a default judgment and you need to apply for a set-aside on return.
And for good measure I’d also email the change of address too and ask for confirmation of receipt. In addition write and email any other agent (like debt collector and/or solicitor) who gets involved between now and your departure with the same change of address details and a request for confirmation of receipt).Please note, we are not a legal advice forum.
