Vehicle Control Services Ltd PCN at Lidl Carpark Final Demand Notice

ticket issued by VCS in Lidl carpark for parking in a non-designated area 07/08/17. I wrote a letter refusing to pay and requested them to stop processing my information (section 10 notice). There response (7/09/17) is attached. Then on 10/10/17, I received final demand notice from VCS to pay £100 by 20/10/17.
I have been recommended to go to ICO as VCS failed to respond to section 10 notice. I am struggling to put words together for ICO as not fully glued up on the law terminology (and my rights i.e. caused harassment/distress/anxiety). Any advice/template for ICO.
Also, what is the worst that could happen for RK or the Driver? Can they investigate lidl footage as the RK didn't name the driver and the charge is being pursued from the RK.
Sincere apologies for so many questions but I am confused and a bit worried.
Any help/advice on the above will be much appreciated.

    Firstly, have you complained to LIDL yet? Most people with LIDL tickets who can show they are customers email the CEO and his people generally get the ticket cancelled once patronage of the store is proven (e.g. bank statements, receipts etc.)

    Nearly all of those questions have been answered in the stickies, have you read them?

    It is a lot to get you head round, but unless you want to be taken to court you will have to acquaint yourself with the rules of the game which you have be co-opted into.
    You never know how far you can go until you go too far.

    Hi safarmuk, yes, that was the first thing I did. Lidl responded that this car park belongs to the retail park (Lidl and other shops/businesses) as a whole who has contracted VCS for car park managements. So they could not help further.

    I agree, this isn’t a Lidl case (they are firmly in bed with Athena). You are looking for a Managing Agent who controls the whole retail park to complain to.

    There’s no CCTV footage that they can access - this is a parking charge, not an armed robbery or terrorist atrack! Too much telly!

    when they responded in september , their refusal to cancel should have come with a POPLA code

    so did you get a POPLA code ?

    if yes , WHY did you not complete and submit a POPLA appeal ?

    I did read the newbies sticky, and there was no mention of complaining to ICO unless a different terminology is used, hence I am confused. So based on the OP, do I complain to ICO or not. I have attached VCS response to section 10 notice for your consideration.

    In their refusal letter, they suggested me to take the matter to IAS within 21 days (which I didn't unfortunately) and now I have been forwarded the Final Demand Notice. there was no mention of POPLA / POPLA code. I believe they are member of IPC (independent parking committee whereas POPLA is for BPA members, maybe!)

    all this talk of the ICO is sidetracking the basics of appealing a pcn

    1) you appeal to VCS , they refuse to cancel

    2) you appeal to POPLA using the supplied POPLA code

    any talk of ICO involvment tends to be much later down the track once you have cause to pursue a DPA breach claim, rarely is an ICO complaint made for this other stuff
