My thinking is that a call to the probate registry would be helpful: the OP may find that she can apply for LofA on her ex's estate on behalf of her children.

I think there have been threads on here before where the parent did that for the children.

It's a concern that the house has been sold - that suggests that someone has administered the estate and cut out the real beneficiaries. :(

So how has "someone" managed to administer the estate and sell a house without applying for LofA?

I think that the house that was sold belonged to the children's grandfather. It is the the children's father who has not yet got LofA

The father died before the grandfather so the grandfather's estate should have passed directly to the grandchildren.

I agree that we might expect that to the case but there was a post by the OP recently that seems to imply that grant is needed for the boy's father - also there was a post where the solicitors said this was needed before the money could be released
The letter says !!!8216;A grant of representation will need to be obtained in the estate of my boys!!!8217; father. Either probate if there was a will ( I don!!!8217;t think there was) or letters of administration if there was no will. Because the beneficiaries are under 18, a minimum of two persons have to make the application for the grant of representation.
    What does this mean?
What is a grant of representation and who can apply for it?

That makes no sense - the inheritance wouldn’t pass through the father’s estate because he died before the grandfather (his father).

It sounds very much like the solicitor believes that the father died AFTER the grandfather. Maybe it would help if you re-emphasise to them that the father died first and provide a copy of the death certificate as proof.

Thanks for your reply. I don’t have a copy of his death certificate, we seperated in 2005. I can’t seem to find a record of his death in births, deaths & marriages either.

If you know the date of your ex’s death, order a copy from here.
