Not Happy

Hi
I recently went for a job at a reputable supermarket after filling in the online application with questions then to my surprise I was asked for an interview, I was delighted when they rang and offered me a job they asked that I bring identification along so I went armed with my birth certificate and proof of my national insurance number , they further rang to say would need my marriage certificate which I then provided however because I changed my name to my married name by deed poll this wasn't good enough I no longer have the deed poll papers as it was over 20 years ago the birth certificate and marriage certificate have my father's name on it and also my marriage wouldn't be legal if they hadn't seen the relevant papers. I do not hold a passport as I have never needed one and a driving license as I don't drive . I went to the job centre and the ladies reply was "what do you want me to do about it " I am absolutely devastated as it took a lot for me to get myself back out there I am disgusted that I AM BRITISH and can not get a job in my own country

  • You can get a job in this country....they rang and offered you one.

What you can't do is prove your identity. This article (easily googled) should help.

  • No they will not employ me as I did not have the deed poll so yes they offered but never took me on

mandyminx - do you have a copy of the deed poll now so that you can avoid being in this situation again?

  • you could have googled and found the link provided above, which explains how you can obtain a copy or new deed poll. so yes, you can get a job here. but as with everyone else working for a company that does things legally, you have to prove your right to work.

perhaps consider investing in a passport or driving licence to make this easier in future, and have a specific safe place for important documents.

  • Reputable employers won't employ anyone without definitive proof of eligibility to work as the fines are way too high.

The risk just isn't worth it, especially for a low skilled job like shop work.

(nothing against shop workers, my wife is one.)

The employer is required to check your eligibility to work. That applies however loud you shout.

atolaas's advice is excellent, ensure you have the correct documentation so you don't have the same problem next time.
  • I have rang the solicitors today and I am waiting to hear back I am going to apply for a driving license as well just for ID however my gripe is my marriage certificate wouldn't be legal if I hadn't showed it to them and having my father's name on it my son is a manager and said they can go through your NI number as you have that for life I feel so let down.

Mandy, the problem is that employers are now required to check that people have the right to work in this country. It's a bit like the rules imposed on banks and lawyers etc to comply with anti-money-laundering and anti-terror legislation. Most companies will have blanket policies to do the same checks for everyone so they are not making assumptions about anyone's nationality or right to work.

Companies will have policies and probably have a very specific list of what they can and can't accept.

You are likely to find the same or similar requirements with any reputable employer.

If you changed your name by deed poll and registered you should be able to get a duplicate (although is you don't have the reference umber you may have to pay for search to find it)

If you just did a change of name need, or a deed poll that you didn't register, then the simplest option will be to do a new one - there is a suggested form of words here .
All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)
  • I understand that however the job centre told me that what I had was sufficient it also says on gov site birth certificate and proof of NI so that's what I took

The Jobcentre are not the ones that get fined if they employ you without sufficient checks.

The reason your birth certificate is not sufficient is that your name has changed, they cannot verify it is yours.

Has the supermarket withdrawn the job offer? If you explained they may allow you to start at a later date.
