I have to say but I went to university and also worked throughout my time there. I had no idea that the SU had "legal services", not least because my SU seemed to be run mainly by 3rd year students who were only slightly less clueless than me!
I also wouldn't have trusted them to offer me sound legal advice in much the same way that an EMPLOYMENT union would.
I probably would have either gone to my parents/this forum or the Citizens Advice Bureau.
I also probably would have sacked off the job and applied for KFC or Tesco.
Yes I think they realise they made a mistake about the union so are just lashing out a bit.
I had the same experience as you. I wouldn't have trusted my student union to get involved in a pay dispute with my off university employer!0 -
No, I don't know how you came to the conclusion that I am a "Troll" I definitely am not. I was only looking for some advice, but to answer your question, 99% of the payments made by customers were made by card as we were provided with a wireless chip and pin machine and all the transactions go straight into the owners account. (Delivery and Tips included)
Thanks to everyone else though for taking the time to provide me with some much needed advice, it confirmed what friends and family have told me, that I was getting the utter pee taken out of me in that job so I decided to leave after my shift last night. People really do take kindness as weakness
I guess that I will just have to put it down to a bad experience.
Many Thanks, Sarah
Im pleased you've decided to find something else. You can still claim for the monies owed (difference between what they paid & minimum wage) but it will require effort & time on your part.0 -
What did he say out of interest.
I read the bit about tips...................I would have told all the deliveries not to tip as you/I don't get it. ;-]0 -
Well done on taking a stand. Perhaps you can let HMRC know about them here:
https://www.gov.uk/government/organisations/hm-revenue-customs/contact/national-minimum-wage-enquiries-and-complaints
Odds are they are probably not paying proper amount of tax or NI too.
Tackling this yourself via small claims court is also an option.

NMW doesn't apply to self-employed which I guess would be claimed is the OP's status.
OP probably also earns too little for NI to be due even if they were employed.
Sorry if I missed something which confirm they are employed.0 -

I'm not 100% certain that using the NUS's legal partner and paying up to £250 an hour for a solicitor is the kind of help the OP was after.0 -

You're quite right, but its all academic now the OP has left the job.
I just hope they report the firm to HMRC.Originally Posted by shortcrust

The takeaway job in question sounds like a one right at the bottom of the scale.
I did delivery work once for a Chinese and I got £15 a night (4 hour shift) plus delivery charges (which ranged from £1-£4) and tips. I also delivered for a pizza place on a similar deal. Also got free takeaway at the end of the night.
This was a few years ago now and not something I would do again unless it was proper employed work with company insurance that met NMW + delivery + tips.
Also OP, how do they keep tips unless you are telling them that you got a tip, just pocket it and say nothing.0 -
She explained that 99 per cent of the tips were paid by card and went straight to the owners account.0

Well that's not a proper tip is it. I tip if I receive good service, I wouldn't be tipping when I made the order.
EDIT: card machine at the door - I would just not process the "tip" in with the payment as a principle. If the customer says you forgot to add the tip just tell them it doesn't matter.0
