In certain circumstances, failure to comply with the provisions of the Consumer Contracts Regulations 2013 renders a contract null and void.
But this isn't one of those circumstances.

Here is the whole of Regulation 41 of the CCRs:
    Help-line charges over basic rate

41.—(1) Where a trader operates a telephone line for the purpose of consumers contacting the trader by telephone in relation to contracts entered into with the trader, a consumer contacting the trader must not be bound to pay more than the basic rate.

    (2) If in those circumstances a consumer who contacts a trader in relation to a contract is bound to pay more than the basic rate, the contract is to be treated as providing for the trader to pay to the consumer any amount by which the charge paid by the consumer for the call is more than the basic rate.
So the remedy seems to be a refund of the excess from the trader.
    Good luck with that. ;)

Not in the murky world this forum deals with!

You are giving the OP false hope!

  • my apologies and will do
  • I'm in the same boat at exactly the same Lidl, having received the ticket today. I just wondered if since this conversation ended there has been any further developments like a court summons or other tactics?

There won't be any 'court summons' as this isn't a criminal case. And there'll be no 'court' anything as this is Athena and they don't do court.

You need to email Christian Härtnagel (note spelling), Lidl's CEO on the 'donotreply' email address covered in other 'Lidl Athena' threads. Do a forum search using the two names.

    How to search the forum:
Use the Forum Jump button (one near the top and one near bottom of this page) to get back to the forum thread list. Just above the threads, on the right, is a heading along a line, next to forum tools, called 'Search this Forum'. Put your key word(s) in and change the default search from 'Show Threads' to 'Show Posts'.

Also read the NEWBIES FAQ sticky, post #1, because you'll need to understand the game you're now involved in. Then any further questions, please start a new thread of your own.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
