  • I had a reply from Urban Waterside, who said they have "no legal interest in the land or building at Newcastle Under Lyme".


    So I wonder who has engaged "Euro Parking Services" then...?
  • Well if they say Urban, then its them. but they have no interest in the land - e.g. any title to it - meaning they cannot offer the right to create parking contracts to the parking firm.
  • Out of interest, might be a silly question, if it goes to court, is it a court close to where you live or where the parking service are based?

  • I must admit, I'm having a bit of a wobble on this and whether I want to stick it out and potentially go to court (I don't even own a suit that fits me!). I have taken it personally, which I know is not the case, and am just wondering whether to just pay up and it's done, as much as I loath to, but I don't need this hanging over me.


    Anyway I had a reply via email to the "sticky" recommended letter I sent, which as I read it wasn't an actual "appeal".



    This was their reply:


    "Thank you for your appeal received on 19/10/2017 regarding the Parking Charge Notice referred to above. We have reviewed

    your appeal and in doing so, we took into account the representations that you made in support of your appeal as well as


    evidence which was submitted by the parking attendant. We reached the decision that in this instance, the Parking Charge


    was issued correctly for the following reason


    The car park is free for patrons whilst on the premises only. This is in place so that there is sufficient spaces available for


    customers. Any vehicle found parked onsite who's driver has gone elsewhere is liable for a parking charge notice (PCN). The


    parking attendant did not find the driver in-store at the time the PCN was issued. The parking attendant observed the driver


    later returning from elsewhere. The signs are prominently displayed in and around the site and are obvious to any person who


    enters the site. It is incumbent upon motorists to read them. If they choose to ignore them then they submit to the terms


    nonetheless.


    We are therefore unable to cancel the Parking Charge Notice as it was issued correctly. Please now make payment of £100 to


    reach us by 29/11/2017. If you believe this decision is incorrect, you are entitled to appeal to the Independent Appeals Service


    (IAS). The Independent Appeals Service (https://www.theIAS.org) provides an Alternative Dispute Resolution scheme for disputes of


    this type. As you have complied with our internal appeals procedure you may use, and we will engage with, the IAS Non


    Standard Appeals Service providing you lodge an appeal to them within 21 days of this rejection


    In order to appeal, you will need your parking charge number, your vehicle registration and the date the charge was originally


    issued. However, if you choose this option your Parking Charge will automatically increase to £100. Please visit

    Payments can be made by cheque or postal order made payable to Euro Parking Services Ltd. Please ensure you write your


    Parking Charge Notice number clearly on the reverse. Please do not send cash through the post. Payment can be made using


    a debit or credit card by calling the automated payment line on 0845 121 0065 or online at https://www.europarkingservices.com. For

    Your OP says you are following the newbies faq thread advice on what to do.


    The faq does advise that your appeal would be futile, and that you should expect the rejection.


    Now ignore everything from the ppc or their debt collectors except court correspondence or a lbcca.


    Though always worth keeping on at the landowner & Lidl to get this cancelled

    Offering a premium rate 0845 number is a breach of BIS regulations in force since 13 June 2014. See Regulation 41 of the Consumer Contracts Regulations 2013. This can be reported to the Citizen's Advice national Consumer Helpline on 0345 404 0506.

    Failing to declare call charges immediately alongside a premium rate 0845 number breaches Ofcom regulations in force since 1 July 2015. See the "Conditions binding non-providers". This can be reported to ASA.
