Sports Direct Returns - they want it both ways

I bought a top from Sports Direct online last week, the item was £36.99, the delivery charge was £4.99, the total I paid was £41.98
The size was too small, so I returned it to them the following day via recorded delivery. I asked for a refund.
*Their website states that I pay for the return postage and I dont have a problem with that part of it*
But the refund they issued me was for £36.99, I think it should be for the full amount of £41.98, ... any advice appreciated ?

Sports direct return policy is clear. http://www.sportsdirect.com/customerservices/completedorders/returnsandexchanges
Did you cancel properly as per your consumer rights? If you just send it back without cancelling properly they will just take advantage of this.0 -
Yes they should refund the outgoing postage, providing you informed them of your wish to cancel. They even mention it in their terms. If a full refund including the original delivery costs is required, we need to be informed fourteen (14) days after the receipt of the order.
If you notified them, then you will need to contact them to get the £4.99 back.0 -
Online purchases
To return an item(s) firstly print the Returns Form, complete it and return it with your invoice and goods to:
Customer Returns,
Wareshop2 Limited,
Unit A,
Brook Park East,
Shirebrook.

I did exactly what is printed above, the goods were returned 1 day after I recieved them

A few lines below that it says:If a full refund including the original delivery costs is required, we need to be informed fourteen (14) days after the receipt of the order. The order must be then returned to us within fourteen (14) days after we have been informed of the cancellation, however you will be responsible for the cost of returns the goods to us. If a return is payable to you we will process the refund as soon as possible and, in any case within fourteen (14) days of receipt of the original order back to us.
There is a word missing from the first sentence.
The first sentence should read:If a full refund including the original delivery costs is required, we need to be informed within fourteen (14) days after the receipt of the order.0 -
Do they stipulate HOW to inform them? If not then receiving the goods back (as per their own T&Cs) is informing them.
SD are obliged to abide by the law ... OP is legally entitled to the initial postage charge refund.0 -
I did get the refund, but only after emailing them stating I required a full refund including the postal charge. They didn't quibble.
If you follow their very first instructions on how to return an item, you won't get the full refund, that seems to be their default.
thanks to all who replied ...

I though that I would add to this thread rather than start a new one.
I purchased two packs (three pairs in each pack) of Puma crew (like walking) socks yesterday - total price £9.
They were clearly marked size 39 - 42 and 6 - 8, and as I take a size 8 I would have expected these to be perfect.
I got them home and last night opened them, and found that they are all far larger, probably around a size 12.
My wife laughed and said they were big enough to use as Christmas socks to put little presents in (cheers dear:o).
Anyway, I went back today and tried to get a refund (little point in an exchange as they are all like that), but they refused, saying that the goods are not faulty, and that all the rest are like that.
I told them, that if they are deliberately selling socks as size 6 - 8 and they are a size 12, then that is a case of misrepresenation and a breach of the sale of goods act.
I have a customer complaint form, but what is my next best step?0 -

Oh no, first rule when demanding your rights is to actually know them.
The Sales of Goods Act was replaced by the Consumer Rights Act.0 -
