Wait for the list of transaction charges they are obliged to provide.

I got a phone call the other day from a company which I apparently emailed or wrote to some time ago about bank account charges, they said I can reclaim through financial hardship because I have a credit card even though it isnt with my bank..

What do I need to do? I already applied for my overdraft fees back ages ago but was put on hold because the banks went to court, I think they owed me something like £360.Love United - Hate Glazer0 -

(a) make sure you have not agreed to any contract with a claims management company.
(b) read the MSE articles on reclaiming bank charges, and the other information such as the sticky thread on financial hardship online resources. I'm fairly new to the site generally and this forum specifically. I'd really appreciate some guidance please!! I stupidly engaged one of those "refund-chasing" companies to pursue both credit card charges and mis-sold PPI. However, this post is purely about re-claiming charges (as opposed to PPI). The company (Claims Financial) have negotiated a few refunds - mostly around £100 - £250 from some of the credit card companies. Some of the credit card companies have said they will deduct the refund from the arrears due on the credit card account (all the credit cards have arrears on them) whereas in other cases, Calims Financial have sent me forms to sign agreeing to the "final refund". I realise now I should have managed the process myself but was put-off by the sheer number of credit card companies involved. Basically, I want to check the following please - the local Citizens advice were pretty useless.
1. If the account is in arrears can the credit card company offset any refund against the arrears and thus not actually pay the arrears. (I'm sure this will be the case but thought I'd ask anyway!).
2. If the refunds will not actually be paid, how do I stand will Claims Financial's 25% fee. Do they still need to be paid, which I mpost definitely cant afford.
3. Would it be worthwhile referring the cases to the Fiancial Ombudsman for any reason?
Claims Financial have not got back to me on any of the PPI claims yet other than to send me a stack of forms to complete which they will apparently send to the Ombudsman.
Sorry this is such a long and messy note. I really would appreciate and value any input however as I think I have just got myself into another mess.

Yes the card companies can offset any refund back to you off the arrears on the account.
Yes, Claims Financial will still expect to be paid their fee, even if you haven't received the money back direct.
Not sure on what basis you are thinking of sending to the ombudsman, sounds like they have either already paid you or Claims Financial are sending to the fos on your behalf? Do you know exactly what point in the process you (or they) are up to as you would need all the information before pursuing this route yourself.0 -
Thanks for that. I really cant afford to pay yet another creditor so will have to take that up with the company.
I'm not really sure what basis I'm hoping to take this to the Ombudsman! I was just hoping there might be some basis on which to proceed. If I'd done this right, I'd have instigated the process when the credit cards were still active, or at least managed the process myself from the start.

The cards don't need to be active to reclaim but there is a basic process to follow. Obviously you must have a record of all your charges, then you write a first letter to the company asking for them to be returned (can also ask for interest). If they don't respond or you aren't happy with their initial offer then you write a second letter giving them a time-frame to respond or you will escalate it to either court action or the fos. I chose the court route but all but one backed down before it came to that point.
So basically you can choose to take to the fos if you want to go down that route but you need to show that you have approached the company directly first and have not been able to reach a satisfactory result with them. If your claims company is doing this for you then you would to check they had done this and get the details before you would be able to go the ombudsman with it yourself.0 -

I'ts all going well so far , but we're claiming for a hsbc credit card , charges and ppi , but got a letter back saying we can have the charges back , £84 , but if we take that we cant claim for anything else on the card , I'm not sure if that means anymore charges , or they know that we're also claiming for the ppi on the card and maybe they know its alot more than £84 , but we have'nt got the information for how much the ppi was on the card yet , and we have only 10 days to send the letter back to get the £84 , so I'm stuck on what to do !!

I would suggest that you have every right to reclaim BOTH as they were independent breaches of the law. However, it would seem that they are trying to get you to "settle" with that clause in writing so that they can prevent you from claiming for PPI. I'm not sure how legally binding this would be. I think I would write back and reassert my right to claim for seperate breaches of contract/PPI where there is legal cause and remind them that you will pursue them through the courts if necessary. You are settling for the charges only, so tell them so! The alternative would be to delay the charges reclaim until the PPI result is in.0
