... I think a few CC companies are now seeing that the FOS are starting to back Egg every time so have decided to just say no to everyone - while also dragging it out as long as possible. That way you have to go to the FOS, which can take a long time, or take them to court, and a lot of people would back down at this stage
I'm not sure what you mean here.
The FOS will only usually award the difference between the amount owed and the £12 the OFT has said it would takle action itself against should a company charge more than this.
In the case of Egg, this amount is £16, because evidence has been provided by Egg to justify the higher charge.
You can only hope to get the £12 (£16 in case of Egg) charges back if you take the matter to court alleging the charges are unfair. Your hope then is that the comapny offers a ggodwill gesture, without admitting any liability, for the full amount of the claim. (a bit like the banks used to do before they put their foot down because they were giving away too much money)

Hi,
I am looking for some advice please. . I received a letter back from Halifax offering me payment of £73.65, however my charges including 8% interest totalled £354.81.
The letter from them says “whilst not agreeing with the analysis of default fees in the Office of Fair Trading’s statement in April 06, nevertheless we reduced these fees to £12 with effect from 1 Aug 06. Therefore this refund is equal to the difference between the amount you were originally charged and £12. I also included net interest of £21.65 at an annual gross rate of 8%”.
They then go on to say that when the account was opened, I agreed to their terms and condition which explained when charges would be applied to the account.
They say the payment will go into my existing account in 5 days. Please can someone advise what I should do I am not happy with this offer. Many thanks0 -
Wrote to BoS requesting refund of £229 in late payment charges on my BoS credit card which includes £54 interest going back over six years
Received their response today saying they are willing to offer £78 as refund of the difference in charges (£12 post 2006 and £20 pre) which includes interest at 8% annual rate
Any one have any idea whether this is standard tactic and whether i should accept or reject this first offer
I'm up for rejecting and pushing them for more since had similar experience with Mint who subsequently upped their offer after i rejected the first one (£66 to £128)
Any thoughts appreciated on tactics to employ?0 -

There is a chance it’ll offer some of the money you want. If you have asked for the full refund this may be the difference between the fee and the £12 OFT recommendation. Whatever it offers, you need to decide whether it’s worth continuing or just taking the cash.Should you accept a partial offer at this stage?

It is fairly standard for them to offer the difference between the £12 and the higher charges first. If you are not happy with the offer then write back to them and say that you want a full refund of all charges (I have quoted OFT guidelines in a post further up the page if you wish to include).0

Does anyone have tel numbers for cap one and cap one that are in uk, to call the department that looks after the complaints for credit card charges....
An over zealous flatmate thrw two letters from said address away, which were offers from both....Id like to call them and talk to them.

Believe me, you have no chance of speaking to the Executive department, they do not accept calls. Capital One UK based staff normally refuse to speak to anyone too, and all verbal communication seems to be with the call centre in the Philippines. Any call made to Capital One automatically goes out to that call centre and trying to get them to transfer you is almost impossible. I've never known a more unhelpful company. I've been on this week to try and get a copy of a letter they claim to have sent me on the 18th August. I spoke to 2 seperate people in their "customer services" department and was blocked from speaking to anyone in the UK. Infact the operative I spoke to, then went and spoke to someone in the UK, came back to me, said they were all busy and I had to dictate a message to him that i wanted passed on. Total waste of time! Best bet is to write in, where they will pay no attention to anything you have wrote, send a generic template back stating they are looking into your complaint (they aren't) then do something about it the day before 40 days is up. If you do speak to anyone in the UK, they are just team leaders for the call centre abroad and have no authority to discuss any charge claim, just pass on a message for you. Rant over........ :mad:

Based on my experience and what I have read on here and the CAG website they tend to offer the difference between the £20 and £12 charge, no more unless you file court papers against themWage Day Advance, Quick Quid, Pounds to Pocket and Pounds Till Payday....i'm after you0 -
Hi.
I am claiming back charges on my EGG credit card, and I lodged the claim online with Moneyclaim.
I have since Eggs solicitors email to say they would firstly offer the difference between the 2 x £20 charges and reduce them to £16 and pay 8% interest. So i would get £10 odd.
Then When I refused this, I recieved another email offering to reduce all 2x£20 charges, and 36 x £16 charges to £12 and adding 8% interest.
Then when I refused this I received a threatening email saying that as a final offer, EGG are offering a partial settlement of £200 , in full and final settlement, and if I didnt accept, they would take it to court and if the defended the claim, they would claim all their costs incurred.
Is this usual behaviour. Should I continue with this claim?
