    You might want to consider asking for the hearing to be held as a costs hearing - did you file a costs schedule already?

    Also worth checking with the court that they know about the discontinuance even if you don't want a costs hearing to get some money back.

    You might want to consider asking for the hearing to be held as a costs hearing - did you file a costs schedule already?

    If you are up to it, it will need a bit of court-speak to get it going.

    Discontinuance is covered by Rule 38 (CPR 38.5) and your costs by Rule 38.6. However the automatic awarding of costs in CPR 38.6 does not apply to small claims. The court does have discretion under 27.14(2)(g) if Gladstones have been misbehaving (which is normal for them). So you write to the court quoting Rules 38 and 27 to ask for your costs on a discretionary basis as you feel the whole process have been with contempt to the court's role by misusing it / making statements of truth that won't be tested.
