    Dress smartly, as per an interview.

    Get there half an hour early, and take a photo of your P&D ticket if you have to pay for parking! Add it to your costs you want to claim back.

    Do you know about challenging the Rights of Audience of the hired gun who rocks up? By handing in a few pieces of paper (Preliminary Matters documents) to the Usher, once you arrive and have asked the name of the person who will appear for the other side? They can get kicked out/prevented from speaking altogether.

    Gladstones will not appear, so anyone else might be 'not exempt' even though legally qualified.

    No I have never read this on the pages.

    What preliminary documents do I need to give to the usher? I have printed out hard copies of my skeleton argument and costs schedule - is that it?

    SO when I get in I should go up to the usher and hand over docs and ask who will appear for the other side?

    I also read that if they try to hand in any new evidence I can simply say I reject it as it was not received in time?

    Sorry Coupon mad - I did this earlier! I got the law gazette and any law it referred to. I was just checking that is all that "preliminary matters docs" consisted of.

  • I WON!!!! Just wanted to say a massive thank you to everyone who helped; loadsofchildren, coupon mad, claxtome, nosferatu, Johnersh, Ianeman, especially (sorry if I missed anyone who gave advice)!

    I got awarded £91.

    I didn't even get to say anything!!! Their representative was not prepared at all, he didn't even have his own witness statement in front of him! So he tried to refer to evidence, asked to borrow the Judge's version which he refused (I got told off for offering him mine) but then the judge let him use mine. Then the judge asked "do you have any evidence of the placings" and the representative didn't know he did so he said no - and it was dismissed!

    The judge noted how well presented my case was and even the representative said how good my defence was. Thank you so much!

    Happy to share any of my docs for future reference.

    Last questions PROMISE!
    -Do I get a copy of the transcript or is that something you have to pay for?
    -The claimant has to pay me in 14 days - do I have to send them my details or do they do it by cheque?
    -My third case was not consolidated in time - would you write to the Claimant and say "The defendant won their hearing for the first two cases and were awarded costs, so I would like to ask this third case is dropped" or would you write to the court?

    Transcripts you have to pay for. For just the judgement its about £50, you have o go through the court to do this.

    Cheque most likely

    I would write to the claimant and state that as they have vexatiously listed THREE claims of which you managed to get 2 together, and you won, you suggest they immediatley discontinue the final case else yo uwill look to claim full costs under CPR27.14(2)(g) (go read and research this)

    I didn't even get to say anything!!!

    Why not, you were lied to, bullied, threatened, your leasehold tights were compromised, and you did not say anything. Is there any wonder that PPCs profitably infest blocks of flats? Have you considered taking revenge?

    I would now follow The Count's advice, and/or send the PPC an invoice for your time at £19 an hour, which they will ignore. Next, send them a letter before claim, joining in the MA, there are plenty of free example on the internet.

    Then, if they ignore it it is up to you, personally, I would issue a claim, but be under no illusion, you have won nothing - yet.
    You never know how far you can go until you go too far.

    Transcript: no, you have to request (and pay for) this. Did it say anything useful (in which case you might consider donating your £96 to the cause, and of course the transcript will be useful if your third case proceeds - I use a company called Posib, their website explains how to apply).

    Payment: they will send you a cheque. They will probably need chasing.

    Third case: yes, absolutely, do both. Explain that the claim arises from identical circumstances and therefore cannot succeed and invite the court to strike it out and the Claimant to discontinue it. Tell C you will agree to a discontinuance on a costs neutral basis (ie you will not seek costs) but if they continue and you have to defend it you will rely on today's outcome to seek Rule 27.14(2)(g) costs.
