Seller left mess at bottom of garden

Looking for a bit of advice

We got our keys to our new home on Friday and found all manners of broken items and rubbish left at the bottom of the garden, he also left homes in every single last wall in the house and didn't bother to fill them which meant we've been filling and painting all weekend instead of moving in.

We also picked up our keys at 2pm (when agreed he'd be out and detail in my letter from his solicitor) but he has a second set and was in the house until 4:30, I would of let this go if I wasn't for the state he left the place in.

All 3 bins are also full to the top.

I'm just really irritated by it and wondered if we should complain to the solicitor or the estate agent or do we just swallow it and move on?

  • I would recommend that you may try to contact your solicitor in case you can get advice about compensation for this. However, this may takes time.

    Fairly normal for rubbish to be left behind but not holes in every wall. (Unless these are small holes from where pictures were hung).

    If you haven't already, don't remove the items. Request he removes these. If he refuses then advise your solicitor to advise his solicitor you will arrange for these to be removed at his expense.

    Not sure you can do anything about holes unless they were so significant that you needed a professional to plaster. Similarly, filled bins are just a fact of moving unfortunately. When we recently moved we were lucky that it was our bin day. For our new place we weren't so lucky but the previous owners had only half filled the bins so it was fine.

    It's rubbish but you'll likely expend a lot of time and energy for nothing if you pursue it. I'd just let it go. I'm sure you've more important things to worry about.

    Have the lodgers' moved out?:rotfl:

    It is very annoying to be left with the former owner's rubbish.

    Will the council empty the bins or will you have to pay extra?

    You will have to take the garden rubbish to the tip and incur a fee or at least petrol costs?

    You could try to claim your costs from the former owner - other than that you grit your teeth and stand the cost and inconvenience.

    Was anything agreed? I am sure that there is often something in paperwork that says damage will be put right etc. but might not apply if holes where pictures hung.

    When you say rubbish in the garden. Is this in bins or rubbish dumped at the bottom of the garden? If it at the bottom of the garden might want to check that not dumping a prize possession, lol.

    While he is a very naughty boy, treating him like one and telling his solicitor or EA isn't going to result in a spanking, I'm afraid.

    He didn't care when you were present, and he'll care even less now he's away from there.

    The holes, dirt, random stuff that doesn't work, full bins etc is all par for the course on moving in. The only thing that you might have come-back on would be the materials at the bottom of the garden. You could get someone to remove it to the tip and bill him, but what when he ignores this as well? Will you really take it further?

    I would just get rid of the stuff myself at the first opportunity, paint a room or two and do whatever else to start removing all signs that he was ever there.

    Very true. I once got £45 for a smelly old piano stool gleaned in similar circumstances. Someone loved it, horsehair and all! :rotfl:

    If it gives you satisfaction, arrange for it to be delivered to his new place. It'll cost you but then, it's going to cost you anyway.
