small claims court

  • G_M, Yes I checked three times the letter was signed for by same person. I have kept the post office receipts and took photos online of persons signature should I need it for my claim. Small Claims suggest I get expert evidence re looking at the jumper but I have been unable to find anyone online who does this.

To look at the jumper it looks normal and does not look shrunk, normally if you wash something wrong and it shrinks you can tell straight away its your own fault.

£250 for a jumper? Strewth. Owned by the SD chap - wouldn't expect top quality even if it was £250.

I thought it was a typo and the OP meant £25 at first. I can't imagine spending so much on a jumper, but each tot heir own I suppose.
  • Update Cruise fashion ignored the claim I then proceeded to judgement and today have received a cheque from their legal team They want me to return the jumper at my expense by registered post back to them What is a reasonable amount to charge them giving they totally ignored me for months

Charge them for what? Sending the jumper back? Whatever it costs you (providing the charge is reasonable and you don't take unreasonable steps to increase the cost).
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
  • They never made it easy for me all letters ignored never charged them for my costs recorded and registered letters so why should I make it easy for them surely if they want jumper back they should make their own arrangements they certainly did,nt want it back before I am happy to send back jumper but at a cost to my time is that being unfair ??
  • You have received your money back, just post the jumper as requested and stop being petty, your attitude will not do anything for anyone

Ask them to send a pre paid label so you can return the jumper.
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    Well done on your claim.

I believe a court would normally consider it unreasonable for you, as an individual, to charge more than the actual costs you incur. So asking for a prepaid label is probably the quickest way of resolving the matter. (Before returning the item be sure to get the seller to accept in writing that the item is being sent at their risk, subject to you obtaining proof of postage.)

Alternatively, if you wish to be obstructive then at this stage you could just ignore them, or ask them for what you believe is a reasonable amount and take it from there.

Tell them it is waiting for collection -- at their cost and at your convenience.
  • Thank you Keith P I think I will take your advice.

Sparks 2003 I am not being petty and certainly do not have an attitude just wanted to make them feel the same frustration the months it took me to get a result had I not of gone to the court I would still be waiting for a response.
