small claims court

Hi I purchased a jumper online £250 and after one wash following manufactures instructions it shrunk. I returned the jumper only to be told it was my fault and I had washed it wrong, I responded asking for their evidence of this and asked for an amicable solution no response. I sent them a further two letters asking for a response and still no reply, I then sent a letter before action again no response I am now at the point of making a claim. Should I spend yet more money or just write it off they have many bad reviews online about there customer service and even if I get a judgement will they pay any advice please.

    Ref your previous post on the housing forum: 'there' Vs 'their' & 'manufactures'

    * What exactly were the manufacturer's washing instructions?
    * How exactly did you wash?
    * Did you specify both the above in your letters? What were the exact words you used in your (various) letters?
  • Wash 30 degrees mild process, do not bleach/tumble dry. Jumper is 100% cotton so purchased a larger size as website suggested, the jumper shrunk in body and arms, I took advice from Trading Standards and sent a letter outlining problems and asked them to verify their proof that it was an error in the washing procedure.

    They also said that they had sold a high volume of this jumper without any problems, that has no relevance on my complaint and Trading Standards said the onus is on them to prove otherwise. The Company is Cruise who sell mainly designer items, I also asked if they were part of an alternate dispute resolution to resolve the issue before taking further a claim in the small claims court.To date despite sending by recorded delivery and email I have had no response.

    The manufactures test these items thougharaly before putting them into production then the batch test the production version.


    Unless there is a whole load of complaints about this jumper you are not going to get a resolution meaning you need to now prove you didn't wash it incorrectly.


    In this new age of online reviews if there is a problem with this jumper you will find evidence online.

    Money claim on line is £25 for under £300. Dont forget to add the filing cost when you apply.

    £250 for a jumper? Strewth. Owned by the SD chap - wouldn't expect top quality even if it was £250.

    Put the claim in.

    £250 sounds like a lot but to the retailer it's not worth the cost of defending the claim, they'll likely settle as soon as the papers are served. If not you'll have to convince a judge that you followed the instructions - who wouldn't after paying that much??

    I agree with others' comments, but was the letter delivered and signed for, or returned, or sitting in a PO for 6 weeks awaiting collection by the recipient?

    Next time don't use recorded.......

    So far as how you washed it is concerned I'm not sure where the onus of proof will lie: their defence (if they defend) is likely to include the claim that you can't have followed the instructions.

    That seems to suggest that the jumper will shrink. It then becomes a question of 'how much'?
  • Yes they are still trading, I do think they might have a connection to Sports Direct Im sure when I was looking for details about the company it cropped up. In general on website I have found where items shrink normally the retailer will replace or refund A cheap jumper would not have been bothered me but a Moncler £250 jumper and only one wear I feel cheesed off.....hence wanting to go down the small claims route to try and get my money back.thanks for all replies I feel a bit more positive now to take the next step fingers crossed.
