Yodel Parcel Left in the Bin

Ordered some shirts from DressLilly who are based in China.
Yodel Left a note saying the package was left in the bin. When i got home from work the bin was empty. when i spoke to the driver she acknowledged where the package was left and so do Yodel.
Paypal have refused a refund and my appeal.
I opened a Resolver complaint with Yodel who say they will only refund DressLilly who will then refund me.
As you guessed, DressLilly are not answering emails or when they do say i should wait for the delivery???

As they a Chinese based company, are my hands tied or should i push either Yodel or Paypay more?

    Might be difficult - did the trader engage Yodel to deliver it or did you? If they did it your only contract is with the trader and pursuing them in China is going to be next to impossible.


    Did paypal say why they refuse?

    The trader arranged the delivery

    Paypal never left a response as to why the claim and subsequent appeal were denied.

    I could start a resolver with Paypal.

    It seems that PayPal have a habit of rejecting claims when the tracking says delivered.

    How did you pay PayPal? If by credit or debit card you can request a chargeback from your card issuer.

    You can certainly do that, but it might not be a good idea if you or anyone else in your household ever wants to use Paypal again.

    How much money are we talking about here?

    That wont happen as paypal will get the money from the seller, a chargeback wont get you banned from paypal

    No they won't, they have already refused the OP's claim for a refund so they won't suddenly decide yo take the money from the seller just because they do a chargeback.

    The chargeback will leave a negative balance in PayPal and they certainly won't be able to use PayPal again if they owe them money.

    The difficulties you have are that the seller is not in the Uk therefore legislation here won't help. The contract was between the seller and Yodel so no hope there.

    Most bank/credit/debit card companies won't allow a chargeback if you have used Paypal to pay. However, that is not to say you shouldn't at least try.

    I am assuming you opened the case with Paypal under INR (item not received)? Tracking from the seller would win the case for the seller.

    You could open a SNAD (significantly not as described) and cite the box as being empty. If you do win the case (they usually go in favour of the buyer) you will have to return your purchase to the seller via a tracked (visible online) method. This will be at your cost, although there are some offers with Paypal to get a £15 refund on returns postage.

    Have a read of Paypal's buyer protection specifically section 13.

    Posting an empty box or something light won't be expensive, but tracking to China is notoriously bad.
