Not your only options though surely? I'd be asking for a reschedule or to do it by phone.

I am sure that I will be able to re-schedule but that date will still be whilst I am on holiday. The date when all the consultations have to end by is whilst I am on holiday. It is annoying they have had 45 days and leave it to the last two weeks, but perhaps this is normal I have never been in this situation before.

I will think about a telephone consultaion, however I can't see that working as my son will keep interrupting it/I will need to keep an eye on him whilst I am on the call. I need to be able concentrate fully on what I am saying/being told.

So the solution would be in that case to have someone keep an eye on your son when you're on the call?

Surely much better than having to cancel annual leave?

Likewise theres more than a fair chance they'll be to org to do it sooner.

They're following a process - whilst its annoying, it is what it is and they're unlikely to have been able to organise all consultancy sessions where they werent hitting someones annual leave.

Likewise these consultancy sessions are things employers contractuallyhave to do, and i've never found them terribly useful - certainly not useful enough to let it !!!!!! up a holiday or ruin my weekend. :)

    Thanks again everyone.

I need to attend a consultation I know that, it is important and I would be stupid to give the opportunity up. I will not be able to give it the concentration it needs via a telephone call.

I will speak to CAHMS again on Monday about my son and ask advise on how to handle the fallout, which is likely to be horrendous it is going to take me ages to gain back the trust I will have lose with hm. I promised him I would spend everyday with him that is probably my fault as I knew this redundancy situation was happening but I honestly didn't think I would have to attend whilst on holiday :(

I must admit to being confused by this.

I though by law I am entiled to a consultation. I appreciate they have offered me one BUT I am on holiday so in effect they are cancelling my holiday asking me to go into work. To cancel holiday I believe they have to give as much notice as the holiday is, therefore they need to give me two weeks notice after which I will be back on that date?

I can't speak about your company but when I was getting paid off the consultation meetings took 15 mins on the phone for one meeting the second meeting took 45 mins and the final meeting was when we were getting laid off and was handed our termination letter.

You said you were on holiday now so i don't understand why you have to cancel the whole holiday or look for 2 weeks notice when the meetings shouldn't take up every working hour of those two weeks.

Also I'm assuming because you are getting a consultation meeting that more than twenty employees are at risk because if it was less the company don't have to consult and can just give you notice and redundancy pay?

What should the company do wait until you come back your holiday before they can fairly select employees for redundancy. Because if they start the process and you get a pass because your on holiday it will be seen as unfair. Also what happens if other employees are off in coming weeks keep postponing it?

If I am going to do that I might as well go in, there isn't much difference as I live close to work and to my son he will have to be with someone else anyway so whether that is whilst I am at home on a phone call or away makes no difference to him.

For me I would prefer face to face I will find that easier to handle and get my views across than a phone call.

They are not asking you to cancel a week's holiday. At most they would ask you to work a day (but they aren't asking you to work, only to attend a meeting which is likely to be quite short) and for that they need to give you 2 days' notice not 2 weeks.

Fair point I can see that. However what if I was I away for the whole two weeks would I be expected to return form abroad for a day with two days notice?

It seems I am only getting the chance of one consultation, which I think is acceptable.

The company have had over six weeks since the original letter was sent out, of course people are going to be on holiday over this time but if the meetings were arranged earlier within that six weeks plenty of time for staff to re-schedule to a time they weren't on holiday. The company have waited until within the last two weeks of the six week period before even offering dates.

In hindsight perhaps I should have asked to move my holiday so I returned for a week before the consultation end date. But as said before I have never been in this situation before so didn't think to consider this.

Consultation is a two way process you could have started it yourself.

Reality are you going to be able to change anything with your situation.

If they have gone 45days hints at collective consultation what have your reps been doing all this time?

I never realised I could have started it myself :( should I have been told this? In my defense more than once I have been to see HR to explain I am holiday the last two weeks of the consultation period and to express my concerns I haven't heard anything, they never said I could start the process myself, just said they hadn't had final confirmation on what was happening with factory shift patterns yet so were unable to tell me more.

I am not part of a union so don't have a rep. I did read that in this situation someone should be nominated as a rep from us all who are effected but I haven't been told who this is, or if there is one, so assume this is a just a guideline and not part of the official process that has to be followed.
